Résumé: قامت هذه الدراسة على البحث في النظام القانوني لعقود الإدماج، و التي عرفت من خلال هذه الدراسة بأنها"عقود عمل أو توظيف محددة المدة تأخذ شكل نموذجي، يدمج من خلالها الشباب طالبي التشغيل لدى المستخدم العمومي والخاص، لكسب خبرة مهنية تؤهلهم لشغل منصب عمل ثابت لاحقا"، و تمتاز هذه العقود بخصائص تميزها عن غيرها من العقود المشابهة من حيث، التعريف، نطاق ومجال التطبيق، و من حيث الآثار. أيضا ترتب عقود الإدماج جملة من الآثار، تتلخص في مجموع الحقوق و الالتزامات التي يرتبها العقد لكل طرف من أطرافه تجاه الأطراف الآخرين. كما تتنوع عقود الإدماج، بالاعتماد على عدة أسس، كأساس نوع الجهاز أو البرنامج الذي يقوم في إطاره العقد، أو على أساس أنواع الفئات من الشباب التي يضمها هذا العقد، أو على أساس المراسيم التنفيذية المنظمة للعقد، وإن كانت كل هذه الأسس مهما اختلفت تؤدي في النهاية إلى إحصاء نفس الأنواع من عقود الإدماج. كما تم في الفصل الثاني من هذه الدراسة التطرق إلى الأطر القانونية و التنظيمية المستحدثة لعقود ما قبل التشغيل بدءا بنظام القانوني لإدماج عقود ما قبل التشغيل في الوظيفة العامة في مناصب قارة كما تضمن قانون المالية لسنة 2022 إقرار منحة البطالة كحل سياسي لامتصاص البطالة. الكلمات المفتاحية:عقود الإدماج،طالبي التشغيل، منحة البطالة. Summary This studywasbased on researchinto the legal system of integrationcontracts, whichweredefinedthroughthisstudy as "fixed-termwork or employmentcontractsthattake a typicalform, throughwhichyoung people seekingemployment are integratedwith public and privateemployees, to gain professionalexperiencethat qualifies them to occupy a position." fixedworklater." Keywords:integrationcontracts, job seekers, unemploymentgrant Résumé Cette étude s'appuie sur une recherche sur le système juridique des contrats d'insertion, qui ont été définis à travers cette étude comme " des contrats de travail ou de travail à durée déterminée qui revêtent une forme typique, par lesquels des jeunes à la recherche d'un emploi sont intégrés dans des employés publics et privés, pour acquérir une expérience professionnelle qui les qualifie pour occuper ultérieurement un emploi fixe. Les contrats de fusion ont également un certain nombre d'effets, qui se résument dans l'ensemble des droits et obligations que le contrat stipule pour chacune de ses parties envers les autres parties. Les contrats d'insertion varient également en fonction de plusieurs fondements, comme le type de dispositif ou de programme au sein duquel le contrat est basé, ou en fonction des types de groupes de jeunes inclus dans ce contrat, ou encore en fonction des décrets exécutifs réglementant le contrat, même si tous ces fondements sont importants. Les différences conduisent finalement à compter les mêmes types de contrats de fusion. Le deuxième chapitre de cette étude a également abordé les cadres juridiques et réglementaires développés pour les contrats de pré-emploi, à commencer par le système juridique d'intégration des contrats de pré-emploi dans la fonction publique dans les postes permanents. La loi de finances de 2022 prévoyait également l'approbation des contrats de pré-emploi. l'allocation chômage comme solution politique pour résorber le chômage.
