ترتكز الحالة الاستثنائية على عنصر الضرورة الذي ينتج عن وجود خطر داهم يوشك أن يصيب مؤسسات الدولة أو استقلالها أو سلامة ترابها ، ويتم إقرارها من طرف رئيس الجمهورية لمدة 60 يوما وفق شروط دستورية شكلية وموضوعية حددها التعديل الدستوري لسنة 2020 ، يمارس رئيس الجمهورية سلطات استثنائية واسعة خلال الحالة الاستثنائية تظهر من خلال اتخاذه كل الإجراءات الاستثنائية التي تهدف إلى المحافظة على استقلال الأمة والمؤسسات الدستورية في الجمهورية كما تظهر كذلك في إمكانياته في اللجوء إلى آلية التشريع بأوامرفبذلك يمكنه أن?تدخل فيالم?اد?نالمخصصةللبرلمان، وتنتهي الحالة الاستثنائية بانتهاء مدتها أو بزوال الخطر . الكلمات المفتاحية : الحالة الاستثنائية ، مدة الحالة الاستثنائية ، التشريع بأوامر . Résumé: Le cas exceptionnel est fondé sur l'élément de nécessité qui résulte de la présence d'un danger imminent qui est sur le point d'affecter les institutions de l'?tat, son indépendance ou l'intégrité de son territoire, et est approuvé par le président de la République pour une période de 60 jours conformément aux conditions constitutionnelles formelles et objectives fixées par l'amendement constitutionnel de 2020, le président de la République exerce de larges pouvoirs exceptionnels pendant le cas exceptionnel, ce qui se manifeste en prenant toutes les mesures exceptionnelles visant à préserver l'indépendance de la nation et les institutions constitutionnelles de la République, ainsi que ses possibilités de recourir au mécanisme de la législation par ordonnances, de sorte il peut intervenir dans les domaines alloués au parlement, il peut donc le cas exceptionnel se termine à l'expiration de son mandat ou à la disparition du danger .
