و المتطلبة لقيامها مجموعة من الأركان أهمها الركن المفترض، ولمكافحة هده الجريمة تم تخصيص مجموعة من الأساليب الوقائية المتمثلة في الهيئة الوطنية للوقاية والتي أصبحت حاليا ما يسمي بالسلطة العليا للشفافية بالإضافة الي الديوان الوطني لقمع الفساد ومكافحته كما اوجد أساليب خاصة والمتمثلة في التسليم المراقب التسرب والترصد الالكتروني ولتحقيق الردع فرض مجموعة من العقوبات الاصلية والتكميلية علي الشخص الطبيعي واخري علي الشخص المعنوي. الكلمات المفتاحية: جريمة إساءة استغلال الوظيفة، جرائم الفساد، السلطة العليا للشفافية. Summary: The crime of abuse of office is considered one of the corruption crimes stipulated in Law 01/06, which requires the establishment of a group of pillars, the most important of which is the supposed pillar.
