حقوق المحبوسين داخل المؤسسة العقابية

Abstract

لإدارة السجون دور كبير وفعال في محاربة الجريمة والتي تعتبر ظاهرة اجتماعية تترتب عنها أخطار تؤثر على امن أفراد المجتمع، ولقد كان صدور القانون 05-04 المتضمن قانون تنظيم السجون وإعادة الادماج الاجتماعي للمحبوسين الفضل الكبير في إدراج وعصرنة مسألة إعادة تربية المحبوسين والجزائر من الدول التي أصرت على تحسين الظروف داخل المؤسسة العقابية بحيث اخذت بفلسفة الدفاع الاجتماعي الذي كرسته في أحكام دستورها والنصوص التشريعية . ونجاح السياسة العقابية مرتبط بأساليب وطرق المعاملة العقابية التي تتبع داخل المؤسسة العقابية كالرعاية الصحية والاجتماعية والنفسية وغيرها وكذا التعليم وخارج المؤسسة كالوضع تحت الاختبار وإيقاف التنفيذ والحرية النصفية مما يحقق الردع العام والخاص في المجتمع.

Abstract of the master thesis The prison administration has a great and effective role in combating crime, which is considered a social phenomenon that entails dangers that affect the security of members of society. To improve the conditions inside the penal institution, so that it adopted the philosophy of social defense, which it enshrined in the provisions of its constitution and legislative texts. The success of the punitive policy is linked to the methods and methods of punitive treatment that are followed within the penal institution, such as health, social and psychological care, etc., as well as education and outside the institution, such as probation, suspension of execution, and partial freedom, which achieves public and private deterrence in society.

L'administration pénitentiaire joue un rôle important et efficace dans la lutte contre la criminalité, considérée comme un phénomène social qui comporte des dangers qui affectent la sécurité des membres de la société. Améliorer les conditions à l'intérieur de l'établissement pénitentiaire, afin qu'il adopte la philosophie de la défense sociale, qu'elle a inscrits dans les dispositions de sa constitution et de ses textes législatifs. Le succès de la politique punitive est lié aux méthodes et méthodes de traitement punitif qui sont suivies au sein de l'établissement pénitentiaire, telles que la santé, la prise en charge sociale et psychologique, etc., ainsi que l'éducation et à l'extérieur de l'établissement, telles que la probation, la suspension d'exécution, et la liberté partielle, qui réalise la dissuasion publique et privée dans la société.
