ملخص المذكرة باللغة العربية:

تتمتع صناديق الضمان الاجتماعي في الجزائر بإطار قانوني محدد يختلف عن الشركات العامة الأخرى، مما يعني أن أحكام قانون الصفقات العمومية لا تنطبق عليها بشكل منهجي بالنسبة لعمليات الإبرام. إن الوضع القانوني الخاص الذي تتمتع به صناديق الضمان الاجتماعي يبرر خصوصية الإجراءات التي تطبقها لإبرام الصفقات في إطار ممارسة رسالتها النبيلة والاجتماعية العميقة. الغرض من هذه الإجراءات المحددة هو: إدارة وتنظيم ومراقبة جميع المعاملات التي تقوم بها صناديق الضمان الاجتماعي، من أجل ضمان الاستخدام العقلاني والمسؤول للأموال المتاحة للصناديق وبالطريقة المثلى لتمكين تحقيق الأهداف المتوقعة من قبل الصفقات. وأخيرا، يتبين أن الصفقات التي تبرمها الصناديق تساهم في التنمية الاجتماعية والاقتصادية للبلاد من خلال كونها أداة استراتيجية لتحقيق الأهداف المحددة لنظام الضمان الاجتماعي من خلال تنفيذ مشاريع استثمارية، وخاصة في المسائل الصحية والاجتماعية. الكلمات المفتاحية: قانون الصفقات العمومية، القواعد القانونية الخاصة، صناديق الضمان الاجتماعي، الطبيعة القانونية الخاصة.

Abstract: Social security funds in Algeria are governed by a specific legal framework that differs from that of other public entities, which means that the provisions of public procurement law do not systematically apply to their contracting procedures. The special legal status granted to social security funds justifies the unique procedures they implement when awarding contracts, in line with the noble and deeply social mission they fulfill. The purpose of these specific procedures is to manage, regulate, and monitor all transactions carried out by the social security funds, in order to ensure the rational and responsible use of the available financial resources, and to optimize their use in a way that enables the achievement of the objectives set for such contracts. Ultimately, it becomes evident that the contracts concluded by the funds contribute to the social and economic development of the country by serving as a strategic tool to achieve the defined goals of the social security system, particularly through the implementation of investment projects in health and social sectors.
