الحكومة البرلمانية في القانون البرلماني الجزائري

Abstract

تتلخص دراسة موضوع الحوكمة البرلمانية في الجزائر حول أن هذا المفهوم يعني تحديث وترشيد البرلمان وفق مبادئ و معايير ترتقي به ضمن البرلمانات الحقيقية و الفعالة، والمؤسسة التي تمارس وظائفها التشريعية و الرقابية باستقلالية و التي تمثل الشعب و تعبر عن تطلعاته بفعالية باعتبارها أداة للمشاركة في ممارسة السلطة و تدبير الشأن العام ،و يتم ذلك بتفاعل عدة أطراف لأجل تحسينه و تجويده وبما أن الدراسة تتمحور حول البرلمان الجزائري تبين من خلالها ضعف أداءه وتراجعه و سلبيته و انه من العوامل التي أدت إلى هذه السلبية في الأداء للتدخل المستمر و المقنن للسلطة التنفيذية في إعمال البرلمان، و تنظيمه وحتى إدارة هياكله مما رتب عدم فعالية أداء هذا الأخير هذا ما يقتضي إتباع استراتيجيات إصلاح شامل لمؤسسة البرلمان من اجل تحسينه وتطويره لاسترجاع مكانته من ناحية و بما يتماشى و خصوصيات المجتمع الجزائري من ناحية أخرى. ومن ثم فان الحوكمة البرلمانية ضرورة دستورية تقتضي تعديل الأحكام الدستورية المتعلقة بالسلطة التشريعية بما يعزز و يقوي سلطات هذه الأخيرة و التخفيف من حدة التدخل من طرف السلطة التنفيذية فالبرلمان في حاجة للاستقلالية والمساواة و الاصلاح وتأهيل البنية المؤسساتية و يتحقق ذلك وفق معايير الحوكمة البرلمانية عمقها هي حوكمة للدولة و المجتمع. الكلمات المفتاحية: الحوكمة _ البرلمان _ العضوية البرلمانية _ حوكمة البرلمان. Summary. Therefore, parliamentary governance is a constitutional necessity that requires amending the constitutional provisions relating to the legislative branch in such a way as to increase and strengthen the powers of the latter and to mitigate the interference of the executive branch. Parliament needs independence, equality, reform and rehabilitation of the institutional structure and this is done in accordance with the standards of parliamentary governance whose depth is the governance of the state and society. L'étude de la question de la gouvernance parlementaire en Algérie se résume dans le fait que ce concept signifie la modernisation et la rationalisation du parlement selon des principes et des normes qui l'élèvent au sein de parlements réels et efficaces et de l'institution qui exerce ses fonctions législatives et de contrôle de manière indépendante et indépendante. qui représente le peuple et exprime efficacement ses aspirations en tant qu'outil de participation à l'exercice du pouvoir et à la gestion des affaires publiques, et cela se fait avec l'interaction de plusieurs parties en vue de l'améliorer et de l'améliorer, et puisque l'étude s'articule autour de l'Algérien Parlement a travers elle, il a été constaté que sa performance était faible, régressive et négative, et que l'un des facteurs qui ont conduit à cette performance négative est l'intervention continue et codifiée de l'autorité exécutive dans le travail et l'organisation du Parlement et même la gestion des ses structures, ce qui a conduit à l'inefficacité des performances de cette dernière, afin de l'améliorer et de la développer pour retrouver sa place d'une part et en adéquation avec les particularités de la société algérienne d'autre part.. Par conséquent, la gouvernance parlementaire est une nécessité constitutionnelle qui exige de modifier les dispositions constitutionnelles relatives au pouvoir législatif de manière à accroître et à renforcer les pouvoirs de ce dernier et à atténuer les ingérences du pouvoir exécutif. Le Parlement a besoin d'indépendance, d'égalité, de réforme et de réhabilitation de la structure institutionnelle et cela se fait dans le respect des normes de gouvernance parlementaire dont la profondeur est la gouvernance de l'Etat et de la société..
