تعد نظرية الموظف الفعليمفهوما قضائيا يلعب دورا حاسما في التعزيز من قدرة النظام القانوني على التكيف مع التغيرات الاجتماعية والاقتصادية، اذ أنها تسمح بتقديم العدالة والمرونة في التعامل مع الظروف المغايرة الواقعة على الإدارة كما تسمح باستمرار سير مرافقها بانتظام و إطراد، ومن أجل تحقيق هذا الهدف وجب على الموظف أن يكون على دراية بحدود حقوقه وواجباته كي لا يتجاوزها وإلا وقع في الخطأ يحمله المسؤولية شخصية كانت أو مرفقية على تبعات تصرفات الصادرة عنه. الكلمات المفتاحية: الموظف الفعلي، الخطأ، المسؤولية. Résumé : La théorie du salarié effectif est un concept judiciaire qui joue un rôle décisif dans le renforcement de la capacité du système juridique à s'adapter aux changements sociaux et économiques, car il permet d'assurer la justice et la flexibilité dans le traitement des différentes circonstances affectant l'administration. Il permet également le maintien du fonctionnement régulier et régulier de ses installations, afin d'atteindre cet objectif. Le salarié doit être conscient des limites de ses droits et devoirs pour ne pas les dépasser, sous peine de se tromper. être tenu responsable, qu'il soit personnel ou corporatif, des conséquences de ses actes. Abstract: The theory of the actual employee is a judicial concept that plays a decisive role in enhancing the ability of the legal system to adapt to social and economic changes, as it allows for the provision of justice and flexibility in dealing with the different circumstances affecting the administration. It also allows the continuation of the regular and steady functioning of its facilities, in order to achieve this goal. The employee must be aware of the limits of his rights and duties so as not to exceed them, otherwise he will make a mistake that will hold him responsible, whether personal or corporate, for the consequences of his actions.
