الضبط الاداري من ابرز المواضيع المطروحة على الساحة الدولية عامة والجزائر خاصة، ويتجلى موضوعه في مجمل التدابير التي تنتهجها سلطات الدولة المركزية، غير الممركزة واللامركزية وفقا لتدرج الهرم الاداري ومبدأ الاستقلالية ورغم ان الوزير الأول صاحب الاختصاص العلمي في مجال الضبط الاداري، الا ان المشرع الجزائري لم يتعرض لتمتعه بهاته السلطة صراحة في التعديل الدستوري لسنة 2020 كغيره من الدساتير السابقة. ولقد اظهرت هده الدراسة دور الوزير الاول (رئيس الحكومة)الدي تجسدت صلاحياته خاصة في مجال الضبط الاداري وأثرها في المحافظة على النظام العام بمفهومه الواسع، حيث وقفنا على دالك من خلال ما اصدره من مراسيم تنفيذية وتعليمات وزارية تتضمن جملة من المواد القانونية تتخللها اجراءات وتدابير تضبط وتقيد من حريات وحقوق الافراد ،باستعمال وسائل قانونية ،مادية وبشرية ،تتضمن سلامة المجتمع ووقايته من كل الاخطار، خاصة في الظروف الاستثنائية. الكلمات المفتاحية: الضبط الاداري، سلطات الدولة المركزية، الظروف الاستثنائية، الوزير الاول، رئيس الحكومة. Summary: Administrative control is one of the mostprominenttopicsraised on the international scene in general and in Algeria in particular, and itstopicisreflected in the overallmeasuresadopted by the central, non-centralized and decentralized state authorities in accordance with the hierarchy of the administrative hierarchy and the principle of independence. Although the Prime Minister has the scientific expertise in the field of administrative control, the Algerian legislatordid not explicitly mention hisenjoyment of thisauthority in the constitutionalamendment of 2020, likeotherprevious constitutions. This studydemonstrated the role of the Prime Minister (the Prime Minister), whosepowerswereembodied, especially in the field of administrative control and its impact on maintaining public order in itsbroadsense, as wefoundthisthrough the executivedecrees and ministerial instructions heissuedthatincluded a number of legal articles interspersedwithprocedures. Pouvoirs du Premier ministre ou du chef du gouvernement en matière de contrôle administratif Résumé: Le contrôle administratif est l'un des thèmes les plus marquants évoqués sur la scène internationale en général et en Algérie en particulier, et son thème se reflète dans l'ensemble des mesures adoptées par les autorités étatiques centrales, non centralisées et décentralisées conformément à la hiérarchie des pouvoirs. hiérarchie administrative et principe d'indépendance. Bien que le Premier ministre dispose de l'expertise scientifique dans le domaine du contrôle administratif, le législateur algérien n'a pas mentionné explicitement la jouissance de cette autorité dans l'amendement constitutionnel de 2020, comme d'autres constitutions précédentes. Cette étude a démontré le rôle du Premier ministre (le Premier ministre), dont les pouvoirs étaient incarnés, notamment dans le domaine du contrôle administratif et son impact sur le maintien de l'ordre public au sens large, comme nous l'avons constaté à travers les décrets exécutifs et les instructions ministérielles. il a publié un certain nombre d'articles juridiques entrecoupés de procédures qui contrôlent et restreignent les libertés et les droits des individus, en utilisant des moyens juridiques, matériels et humains, assurent la sécurité de la société et la protègent de tous les dangers, notamment dans des circonstances exceptionnelles.
