Abstract

ملخص

تناولت هذه المذكرة موضوع الإطار القانوني لتسيير المؤسسات العمومية الاستشفائية في الجزائر، حيث تم تحليل النصوص القانونية والتنظيمية التي تحكم عمل هذه المؤسسات، خاصة ما يتعلق بهياكلها الإدارية وسبل تسييرها المالي والبشري. بيّنت الدراسة وجود عدة تحديـــــات من بينها تداخل الاختصاصات، ضعف استقلالية القرار، ونقص الكفاءة الإدارية. كما ناقشت آليات الرقابة ومدى فعاليتها في تحسين الأداء وضمان الشفافية. وانتهت المذكرة بجملة من النتائج الرامية الى إصلاح المنظومة القانونية وتعزيز الحوكمة داخل المؤسسات الصحية.

Résumé ـــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــــ Ce mémorandum porte sur le cadre juridique de la gestion des établissements hospitaliers publics en Algérie. Les textes juridiques et réglementaires régissant le travail de ces institutions ont été analysés, notamment en ce qui concerne leurs structures administratives et leurs modes de gestion financière et humaine. L’étude a révélé plusieurs défis, notamment le chevauchement des juridictions, une faible indépendance décisionnelle et un manque d’efficacité administrative. Il a également abordé les mécanismes de surveillance et leur efficacité pour améliorer les performances et garantir la transparence. Le mémoire conclut par une série de recommandations visant à réformer le système juridique et à renforcer la gouvernance au sein des établissements de santé.

It analyzes the legal and regulatory texts governing the operation of these institutions, particularly regarding their administrative structures and methods of financial and human resource management. The study highlights several challenges, including overlapping responsibilities, weak decision-making autonomy, and a lack of administrative efficiency. It also discusses monitoring mechanisms and their effectiveness in improving performance and ensuring transparency. The thesis concludes with a set of recommendations aimed at reforming the legal system and strengthening governance within health institutions.
