النظام القانوني للسلطة العليا للشفافية والوقاية من الفساد ومكافحته على ضوء التعديل الدستوري 2020

Abstract

بعد التزايد الكبير لجرائم الفساد كان لابد للجزائر أن تتحرك وتتدارك الوضع الذي آلت إليه وتعمل على تجسيد آلية مؤسساتية جديدة تعمل على الحد من هذه الظاهرة ، وهذا ما تم من خلال التعديل الدستوري لسنة 2020 باستحداث مؤسسة رقابية اعترف لها المشرع صراحة بالطابع السلطوي والاستقلالية و المتمثلة في " السلطة العليا للشفافية والوقاية من الفساد ومكافحته" لتحل محل " الهيئة الوطنية للوقاية من الفساد ومكافحته " مع منحها العديد من الصلاحيات للقيام بدورها على اكمل وجه الكلمات المفتاحية : مكافحة الفساد ، السلطة العليا للشفافية والوقاية من الفساد ومكافحته ، الهيئة الوطنية للوقاية من الفساد ومكافحته ، التعديل الدستوري 2020 ، مؤسسات الرقابة Abstract : After the significant increase in corruption crimes, Algeria had to move and rectify the situation it has come to and work on embodying a new institutional mechanism that works to limit this phenomenon, and this was done through the constitutional amendment of 2020 by creating a supervisory institution for which the legislator explicitly recognized the authoritarian and independent character, which is represented in The "Higher Authority for Transparency and the Prevention and Combating of Corruption" to replace the "National Authority for the Prevention and Combating of Corruption" while granting it many powers to carry out its role to the fullest. key words : Anti-corruption, Supreme Authority for Transparency and Prevention and Combating Corruption, National Authority for Prevention and Combating Corruption, Constitutional Amendment 2020, Oversight Institutions.

résumé : Après l'augmentation significative des crimes de corruption, l'Algérie a dû bouger et rectifier la situation dans laquelle elle est arrivée et travailler à incarner un nouveau mécanisme institutionnel qui travaille à limiter ce phénomène, et cela a été fait à travers l'amendement constitutionnel de 2020 en créant une institution de contrôle dont le législateur a explicitement reconnu le caractère autoritaire et indépendant, ce qui est représenté dans " L'Autorité supérieure pour la transparence et la prévention et la lutte contre la corruption " en remplacement de " l'Autorité nationale de prévention et de lutte contre la corruption " tout en lui accordant de nombreux pouvoirs pour remplir pleinement son rôle. les mots clés :
