المجتمع المدني ودوره في دولة القانون في الجزائر بعد التعديل الدستوري لسنة 2020

Abstract

عد الجزائر من الدول السبّاقة في تبني المجتمع المدني مقارنة بالدول العربية الأخرى، حيث اهتم المؤسس الدستوري خاصةً في التعديل الدستوري الأخير لسنة 2020 بدور المجتمع المدني و كذا بالحقوق و الحريات الأساسية التي تسعى الدولة القانونية لحمايتها و التي تحظى بأهمية بالغة باعتبارها ركيزة من الركائز التي يقوم عليها النظام الديمقراطي، ضف إلى ذلك نص الدستور الجزائري على مؤسسات أخرى غير السلطات العامة في الدولة، و هي مؤسسات استشارية تعنى بالحقوق و الحريات و من أهمها المجلس الوطني لحقوق الإنسان كهيئة متخصصة لدعم و ترقية حقوق الإنسان، بالإضافة إلى استحداث المرصد الوطني للمجتمع المدني الذي يعمل على ترقية و تفعيل دور المجتمع المدني على المستوى الوطني. Abstract: Among all the Arab countries Algeria is the first to adopt a civil society within its constitutional amendments, especially the one of 2020, which offers an opportunity to the civil society to be an acting body on the rights and the basic freedoms, which the legal state seeks to protect, as it is one of the pillars of a democratic system. In addition to the advisory institutions decreed in the Algerian constitution dealing with freedoms and the rights of individuals, the most important of which is the National Council for Human Rights as a specialized body to support and promote human rights. Likewise the development of the National Observatory for Civil Society, which promotes and activates its role at the national level.

Résumé : L'Algérie est l'un des premiers pays à adopter la société civile par rapport à d'autres pays arabes, où le fondateur constitutionnel, en particulier dans le dernier amendement constitutionnel de 2020, a prêté attention au rôle de la société civile, ainsi qu'aux droits et libertés fondamentaux que l'?tat légal cherche à protéger, qui sont d'une grande importance en tant que l'un des piliers sur lesquels repose le système démocratique, en plus de cela, la constitution algérienne a stipulé des institutions autres que les autorités publiques de l'?tat, qui sont des institutions consultatives concernées par les droits, les libertés et les libertés et les libertés fondamentales. Le plus important d'entre eux est le Conseil national des droits de l'homme en tant qu'organe spécialisé dans l'appui et la promotion des droits de l'homme, outre la création de l'Observatoire national de la société civile, qui œuvre à la promotion et à l'activation du rôle de la société civile au niveau national.
