النظام القانوني للمنتخب المحلي في الجزائر وتونس

Abstract

يعتبر المنتخب المحلي حجر الأساس لتشكيل المجالس المحلية، باعتبارها الإطار الأقرب لمشاركة المواطنين في تسيير شؤونهم المحلية، عبر آليات الديمقراطية التشاركية في اتخاذ القرار المحلي من جهة ومراقبته من جهة أخرى، كما يعتبر المنتخب المحلي أساس التنمية المحلية، ما حتم على المشرع الجزائري وضع قواعد تضبط كيفية اكتساب صفة المنتخب المحلي، وطرق سير المجالس المحلية المنتخبة، وكذا الصلاحيات والامتيازات المخولة للمنتخب المحلي أثناء القيام بمهامه طيلة عهدته الانتخابية، والتي تنتهي بمجرد انتهاء عضويته داخل هذه المجالس. قيد المشرع الجزائري الصلاحيات الممنوحة للمنتخب المحلي عن طريق سن رقابة إدارية وأخرى غير إدارية عليها حفاظا على ترشيد المال العام وديمومة وحسن سير المرفق العام المحلي، غير أن هذه الرقابات قللت من استقلالية المجالس المحلية مقارنة مع النظام القانوني للمنتخب المحلي في تونس، الذي أعطى من خلاله المشرع التونسي استقلالية أوسع لهذا المنتخب، ما جعلنا نستفيد من ايجابياته مقارنة مع سلبيات النظام القانوني الجزائري وفقا للمعيار الموضوعي والوظيفي. الكلمات المفتاحية: المنتخب المحلي، الجزائر، تونس، قانون الانتخابات. Abstract The local elected is the cornerstone of the formation of local councils. As the nearest framework for citizens' participation to conduct their local affairs, through participatory democracy mechanisms in local decision-making and monitoring,he is considered as the basis of the local development, so that the Algerian legislatorhas established rules governing how to acquire the local elected status and thefunctioningmethods of elected local councils, as well as the local electedpowers and privileges while performinghis functions throughout his term office, which expires by his membership expiry. The Algerian legislator restricted the granted powers to the local electedby enacting administrative and non-administrative control in order to preserve the rationalization of public funds, the permanence and the proper functioning of the local public service, but this control has reduced the local councils autonomycompared to Tunisia's local elected legal system, through which Tunisian legislatorconferredbetter autonomy, this leads us to take its advantages comparing to the Algerian system disadvantages according to objective and functional criteria.
