Abstract

الملخص باللغة العربية: إذا كانت صلاحية التشريع هو إختصاص أصيل للبرلمان، وكانت المحكمة الدستورية المستحدثة في التعديل الدستوري 2020، في بتها في دستورية القوانين قد تجعلها بمثابة من يلقنها دروسا لهذا الأخير في صلب صلاحيتها، وإذا كانت بتدخلها في عضوية المجالس المنتخبة البرلمانية كقاضي إنتخاب من جهة وسلطة تتولى رقابة دستورية القانون العضوي للإنتخابات والنظام الداخلي لغرفتي البرلمان من جهة أخرى، تطرح إشكالية تحكم المحكمة الدستورية غير المباشر في السلطة التشريعية عضويا ووظيفيا. الكلمات المفتاحية: البرلمان، المحكمة الدستورية، التعديل الدستوري 2020.

Rusime : Si le pouvoir législatif constitue une prérogative inhérente au Parlement, et que la détermination de la constitutionnalité des lois par la Cour constitutionnelle peut en faire un sujet d'enseignement pour ce dernier au cœur de ses compétences, son ingérence dans la composition des assemblées parlementaires élues, en tant que juge électoral d'une part, et son autorité de contrôle de la constitutionnalité de la loi organique des élections et du règlement intérieur des chambres du Parlement d'autre part, pose un problème qui régit la Cour constitutionnelle indirecte au sein du pouvoir législatif, tant sur le plan organique que fonctionnel.
