إهتم المشرع الجزائري بالأراضي الفلاحية التابعة للأملاك الوطنية الخاصة للدولة وسن العديد من القوانين والتشريعات من أجل تنظيم كيفية إستغلالها وتسييرها و حمايتها وذلك لما لهذا القطاع من تأثير على التنمية الاقتصادية والاجتماعية للبلاد وعلى هذا الأساس ونظرا للاعتداءات المتكررة على العقار الفلاحي وتطبيقا لأحكام قانون التوجيه العقاري 90-25 و أحكام القانون 08/16 المتضمن التوجيه الفلاحي أنشأت الدولة أليات و وسائل لحمايته والرقابة عليه نذكر منها الديوان الوطني للأراضي الفلاحية وديوان تنمية الزراعة الصناعية بالأراضي الصحراوية ، حيث تعتبر هذه الدواوين هيئات عمومية ذات طابع صناعي وتجاري كلفها المشرع بمهمة ضبط العقار الفلاحي و أوكلت لهم مهمة المراقبة المستمرة والدائمة ومراقبة المستثمرين الفلاحيين في تنفيذ السياسة الاستراتيجية العقارية الفلاحية الجديدة مع مراعاة تدابير تأطير الدولة. الكلمات المفتاحية:العقار الفلاحي، الديوان الوطني للأراضي الفلاحية،وديوان تنمية الزراعة الصناعية بالأراضي الصحراوية. summary: The Algerian legislator paid attention to agricultural lands belonging to the state's private national properties and enacted many laws and legislation in order to regulate how they are exploited, managed and protected due to the impact of this sector on the economic and social development of the country and on this basis and in view of the repeated attacks on agricultural property and in application of the provisions of the Real Estate Directive Law 90- 25 and the provisions of Law 08/16 containing the agricultural directive. The state has established mechanisms and means to protect and control it, among which we mention the National Office of Agricultural Lands and the Office of the Development of Industrial Agriculture in Desert Lands. These offices are considered public bodies of an industrial and commercial nature that the legislator has entrusted with the task of controlling agricultural real estate and entrusted to them. The task of continuous and permanent monitoring and monitoring of agricultural investors in the implementation of the new strategic agricultural real estate policy, taking into account state framing measures.
