دور السلطة التنفيذية في العمل التشريعي في ظل التعديل الدستوري 2020

Abstract

تمت دراسة هذه المذكرة والتي هي بعنوان دور السلطة التنفيذية في العمل التشريعي في ظل التعديل الدستوري 2020، عن طريق تحليل مواد الدستورية و عن طريق خطة مضبوطة حيث تم دراستها في فصلين كاملين جاء الفصل الأول تحت عنوان مظاهر مشاركة السلطة التنفيذية في العملية التشريعية حيث بدوره احتوى على مبحثين الأول مظاهر مشاركة رئيس الجمهورية في العملية التشريعية و الثاني بعنوان مظاهر مشاركة الحكومة في العملية التشريعية اما بالنسبة للفصل الثاني جاء بعنوان مظاهر تدخل و تأثير السلطة التنفيذية في العملية التشريعية و تمت دراسته وفق مبحثين الأول حل المجلس الشعبي الوطني اما ثاني بالقرءة الثانية ، و كخاتمة تم استنتاج نتائج و تقديم اقتراحات . الكلمات المفتاحية: السلطة التنفيذية، التشريع باوامر، مبادرة بالتشريع. Abstract: This memorandum titled "The Role of the Executive Authority in the Legislative Process under the 2020 Constitutional Amendment" has been studied through the analysis of constitutional provisions and a structured plan. It was studied in two comprehensive chapters. The first chapter focused on the aspects of executive authority's participation in the legislative process. It consisted of two sections: the first section discussed the aspects of the President's participation in the legislative process, while the second section addressed the aspects of the government's participation in the legislative process. As for the second chapter, it examined the forms of intervention and influence of the executive authority in the legislative process. It was studied through two sections: the first section discussed the dissolution of the National People's Congress, while the second section covered the second reading. In conclusion, the results were inferred, and recommendations were provided. Keywords: Executive authority, legislative by decrees, legislative initiative. Résumé : Ce mémoire intitulé "Le rôle du pouvoir exécutif dans le processus législatif à la lumière de la révision constitutionnelle de 2020" a été étudié en analysant les dispositions constitutionnelles et en suivant un plan structuré. Il a été étudié en deux chapitres complets. Le premier chapitre porte sur les aspects de la participation du pouvoir exécutif dans le processus législatif, comprenant deux sections. La première section examine les aspects de la participation du président de la République dans le processus législatif, tandis que la deuxième section traite des aspects de la participation du gouvernement dans le processus législatif. Quant au deuxième chapitre, il aborde les aspects de l'intervention et de l'influence du pouvoir exécutif dans le processus législatif, étudiés à travers deux sections. La première section aborde la dissolution de l'Assemblée populaire nationale, tandis que la deuxième section couvre la deuxième lecture. En conclusion, les résultats ont été tirés et des propositions ont été formulées. Mots-clés : Pouvoir exécutif, légiférer par décrets, initiative législative.
