يعتبر موضوع الصفقات العمومية ذا أهمية بالغة في تجسيد مشاريع التنمية الاقتصادية للدولة وعلى هذا الأساس اخضعها المشرع للرقابة التي تعد من أبرز الوظائف الادارية التي تضمن سير العمل الإداري بإستمرارية و معالجة جل النقائص التي تدخل في مجال الصفقات العمومية، حيث تضمن أحكام هذه الرقابة في الباب الخامس من المادة 94 إلى المادة 103 واستحدث المجلس الوطني للصفقات العمومية في أحكام الباب السادس المادة 104 الذي يعول عليه ان يكون اكثر فعالية في الحفاظ على المال العام ، الى غاية صدور التنظيمات الخاصة بالقانون 23/12 المتعلق بالقواعد العامة للصفقات العمومية الكلمات المفتاحية: الصفقات العمومية، الرقابة، تنمية الاقتصادية للدولة . abstract: The subject of public procurementisconsidered of great importance in embodying the state'seconomicdevelopmentprojects. On this basis, the legislator has subjectedit to oversight, whichis one of the mostprominent administrative functionsthatensures the continuity of administrative work and addressesmost of the shortcomingsthatfallwithin the field of public procurement. The provisions of thisoversight are included in Chapter Five. From Article 94 to Article 103, the National Council for Public Procurementintroduced in the provisions of Chapter Six Article 104, whichisreliedupon to be more effective in preserving public money, until the issuance of regulationsrelated to Law 23/12 related to the generalrules for public procurement. Résumé: Le sujet des marchés publics est considéré comme d'une grande importance dans la réalisation des projets de développement économique de l'?tat. C'est pour cette raison que le législateur l'a soumis au contrôle, qui constitue l'une des fonctions administratives les plus importantes, garantissant la continuité du travail administratif et couvrant la plupart des tâches. les manquements qui relèvent du domaine des marchés publics. Les dispositions de ce contrôle sont incluses dans le chapitre cinq de l'article 94 à l'article 103, le Conseil national des marchés publics a introduit dans les dispositions du chapitre six l'article 104, sur lequel s'appuie. être plus efficace dans la préservation de l'argent public, jusqu'à la publication des réglementations liées à la loi 23/12 relative aux règles générales des marchés publics.
