Résumé: أصبحت المقاولاتية ،في السنوات الأخيرة، تشغل حيّزا هاما في برامج ومخططات الإصلاحات الهيكلية وفي استراتيجيات التنمية الاقتصادية والاجتماعية،لهذاأقر المشرع الجزائري بموجب القانون رقم 22/16 المتمم للقانون رقم 90/11المتعلق بعلاقة العمل والقانون 22/22المتمم للأمر 06/03 المتعلق بالوظيفة العمومية عطلة خاصة تحت مسمى عطلة لإنشاء مؤسسة للعامل و الموظف، وما يميزها أنها عطلة بدون أجر يستفيد منها مرة واحدة خلال حياته المهنية، بهدف خلق مناصب الشغل وتفعيل روح المبادرة و نهوض بالعجلة الاقتصادية،. وأثناء فترة عطلة تكون علاقة العمل معلقة، ويحتفظ ا بالحق في إعادة إدماجه في منصب عمله إذا لم يتمكّن من إنجاز مشروعه في مدة العطلة، وفق النصوص القانونية. الكلمات المفتاحية:عطلة لانشاء مؤسسة ،عامل،موظف. Abstract: In recentyears, contractors have occupied an important place in structural reform programmes and schemes and in economic and social developmentstrategies. Law No. 22/16, supplementingAct No. 90/11 on the Employment Relationship, and Act No. 22/22, supplementingOrder No. 06/03 on public employment, approved a specialholidayunder the name of a holiday to establish an enterprise for workers and employees; Whatcharacterizesitisthatitis a one-time unpaidholidayduringhiscareer. In order to create positions of employment and activate the spirit of initiative and promote the economicwheel. During a period of vacation, the employmentrelationshipissuspended and the right to reintegratehimintohis position isreserved if heisunable to completehisproject in the holidayperiod, in accordance withlegal provisions. Résymé: Ces dernières années, les contractants ont joué un rôle déterminant dans les programmes et les programmes de réforme structurelle et dans les stratégies de développement économique et social. Loi no 22/16, complétant la loi no 90/11 sur les relations de travail, et la loi no 22/22, complétant l'ordonnance no 06/03 sur l'emploi dans le secteur public, qui a approuvé un congé spécial au nom d'un jour férié pour créer une entreprise pour les travailleurs et les employés; Ce qui le distingue, c'est qu'il s'agit d'un congé non payé ponctuel au cours de sa carrière. Afin de créer des emplois, d'activer l'entrepreneuriat et de promouvoir la roue économique. La relation de travail est interrompue pendant la période de congé et il se réserve le droit d'être réintégré dans son emploi s'il est incapable de terminer son projet pendant la période de vacances, conformément aux dispositions légales Mots-clés : Vacances pour créer une entreprise, un travailleur, un employé.
