تتناول هذه الدراسة الإطار القانوني للمنازعات الناتجة عن إيجار السكن العمومي الاجتماعي في الجزائر، من خلال تحليل العلاقة التعاقدية بين ديوان الترقية والتسيير العقاري والمستأجر. تُبرز الدراسة إشكالية ازدواجية الجهات القضائية المختصة، وتوصي بتوحيدها، وتحديث العقود النموذجية، وتعزيز آليات التسوية البديلة. وتؤكد على أن معالجة هذه النزاعات تمثل التزامًا قانونيًا واجتماعيًا من الدولة لضمان حق المواطن في السكن، لا سيما الفئات الهشة ذات الدخل المحدود.

Cette étude examine le cadre juridique des litiges issus de la location de logements publics sociaux en Algérie. Elle analyse la relation contractuelle entre l’OPGI et le locataire, en soulignant la complexité liée à la dualité juridictionnelle. L’étude recommande l’unification des compétences judiciaires, la révision des contrats-types et le renforcement des modes alternatifs de règlement. Elle conclut que la résolution efficace de ces litiges constitue un engagement juridique et social essentiel pour garantir le droit au logement, notamment pour les citoyens les plus vulnérables.

Thesis Summary

This study explores the legal framework governing disputes related to public social housing leases in Algeria. It analyzes the contractual relationship between the OPGI and tenants, highlighting the jurisdictional complexity. The research recommends unifying judicial authority, updating standard contracts, and promoting alternative dispute resolution. It concludes that effectively resolving these disputes is a key legal and social responsibility of the State in guaranteeing the right to housing, particularly for low-income and vulnerable populations.
