Abstract

ضوابط الملحق في الصفقات العمومية في ظل القانون 23-12 Controls of the Annex to Public Procurements under Law 23-12 من إعداد الطالبتين: حميدوش سهام مناد سارة

الملخص: يعد الملحق في الصفقات العمومية آلية قانونية ضرورية لتكييف العقد الإداري مع المستجدات الميدانية، شريطة احترام شروطه وإجراءاته كما نص عليها القانون 23/12 ويمثل أداة فعالة لضمان استمرارية المشاريع وتحقيق التوازن المالي، غير أنه قد يتحول إلى وسيلة للتحايل في حال غياب قواعد الرقابة والتخطيط السليم. لذلك فإن ضبط استعماله وتكريسه ضمن إطار مؤسساتي شفاف يعد مدخلاً أساسياً لتحقيق حكامة رشيدة في تسيير المال العام. الكلمات المفتاحية: الملحق، الصفقات العمومية، العقد الإداري، التوازن المالي.

Abstract: The annex to public procurement is a necessary legal mechanism for adapting the administrative contract to developments on the ground, provided its terms and procedures are adhered to, as stipulated in Law 23-12. It represents an effective tool for ensuring project continuity and achieving financial balance. However, it can become a means of fraud in the absence of proper oversight and planning. Therefore, regulating its use and enshrining it within a transparent institutional framework is a fundamental approach to achieving good governance in the management of public funds. Résumé : L'annexe aux marchés publics est un mécanisme juridique nécessaire pour adapter le contrat administratif aux évolutions du terrain, à condition que ses termes et procédures soient respectés, comme le prévoit la loi 23-12. Elle constitue un outil efficace pour assurer la continuité des projets et atteindre l'équilibre financier. Cependant, en l'absence de supervision et de planification adéquates, elle peut devenir un moyen de fraude. Par conséquent, réglementer son utilisation et l'inscrire dans un cadre institutionnel transparent constitue une approche fondamentale pour parvenir à une bonne gouvernance dans la gestion des fonds publics.
