Abstract

فعالية آلية الإستجواب في الرقابة على عمل الحكومة The effectiveness of the interpellation mechanism in monitoring government work من إعداد الطالبتين: باشن نور الهدى خليل شرفي إكرام الملخص: يعتبر الاستجواب البرلماني من أهم و أخطر أدوات الرقابة البرلمانية على أعمال الحكومة في معظم الأنظمة الدستورية. بإعتبار أن هذه الأداة تتضمن إتهام الحكومة . غير أن التنظيم الجزائري جعله وسيلة للإستعلام مما نتج عنه تراجع في إستعماله، و الأمر الذي أدى بالمشرع الجزائري في تعديله في سنة 2020 إلى جعله آلية من آليات الرقابة البرلمانية التي تثير المسؤولية السياسية للحكومة عن طريق إمكانية تحريك ملتمس الرقابة من طرف نواب المجلس الشعبي الوطني دون أعضاء مجلس الأمة مع توسيع مجال إستخدامه و ممارسته . الكلمات المفتاحية: الاستجواب البرلماني، الرقابة البرلمانية، المسؤولية السياسية للحكومة ، ملتمس الرقابة . Abstract : Parliamentary interpellation is one of the most important and dangerous tools of parliamentary oversight of government’s work in majority constitutional systems, given that this tool includes accusing the government. However, the Algerian constitutional organization made it a tool for inquiry, which resulted in a decline to the point of reluctance to use it , which led with the Algerian constitutional founder in his 2020 to make it one of the parliamentary oversight mechanism that raises the political responsibility of the government by allowing the National People's Assembly deputies to initiate a motion of censure, rather than members of the Council of the Nation, while expanding the scope of its use and practice. Résumé : L'interpellation parlementaire est l'un des outils les plus importants et les plus sensibles de contrôle parlemantaire dans les systèmes constitutionnels majoritaires, car elle implique une accusation contre le gouvernement. Toutefois, dans l'organisation constitutionnelle algérienne, elle a été réduite à un simple outil d'information, ce qui a entraîné une diminution de son utilisation. Face à cela, l’égislateur algérien a révisé la Constitution en 2020 pour renforcer ce mécanisme : il permet désormais aux députés de l’Assemblée populaire nationale (et non plus aux membres du Conseil de la Nation) d'engager la responsabilité politique du gouvernement par une motion de censure, tout en élargissant les possibilités d’usage de l’interpellation.
