Abstract

ملخص المذكرة تحت عنوان الرقابة المالية السابقة في التشريع الجزائري ملخص: تُعد الرقابة المالية السابقة من أهم آليات الحوكمة المالية التي تعتمدها الدولة لضمان سلامة صرف المال العام ومشروعية الالتزامات المالية قبل تنفيذها. تهدف هذه الرقابة إلى الوقاية من التجاوزات والانحرافات عبر التأكد المسبق من مطابقة العمليات المالية للقوانين والتنظيمات. وقد عمل التشريع الجزائري، خاصة عبر القانون رقم 23-07 والمرسوم التنفيذي رقم 24-347، على تعزيز هذه الآلية لضمان الشفافية وترشيد النفقات العمومية. وتُمارس هذه الرقابة من قبل أجهزة مختصة كالمراقب الميزانياتي، لتشكل خط الدفاع الأول ضد الفساد وسوء التسيير.

summary: Ex-ante financial control is one of the key financial governance tools adopted by the Algerian state to ensure the legality and soundness of public spending before its execution. This preventive mechanism helps detect and prevent irregularities by verifying the compliance of financial operations with existing laws and regulations. Through legal instruments such as Law No. 23-07 and Executive Decree No. 24-347, Algeria has strengthened this system, which is carried out by designated budgetary controllers to promote transparency and efficiency in managing public funds. Résumé : Le contrôle financier préalable est l’un des mécanismes fondamentaux de la gouvernance budgétaire adoptés par l’État algérien afin d’assurer la légalité des engagements financiers et la bonne gestion des fonds publics avant leur exécution. Ce contrôle préventif vise à détecter toute irrégularité potentielle en amont et à s'assurer de la conformité des opérations aux textes législatifs et réglementaires. Les réformes introduites par la loi n° 23-07 et le décret exécutif n° 24-347 ont renforcé ce dispositif, confié notamment aux contrôleurs budgétaires, dans un souci de transparence et d’efficience dans les dépenses publiques.
