Abstract

Summary:
The Discretionary Power of the Criminal Judge Regarding Evidence in Algerian Legislation
This thesis addresses a central issue in the field of criminal justice, namely the discretionary power of the criminal judge in assessing evidence, as provided for in Algerian legislation.
The core of this work lies in the importance of evidence as an essential tool for uncovering the truth in criminal proceedings and ensuring a balance between the protection of society and the safeguarding of defense rights within the framework of a fair trial.
The study highlights the various manifestations of this power through the examination of different types of evidence, such as confessions, testimonies, observations, presumptions, official reports, etc., and the extent of the judge's freedom in evaluating them. It shows that although this power is broad, it is neither absolute nor arbitrary, but governed by legal and ethical rules aimed at preventing abuse and ensuring the impartiality of judicial decisions.
The thesis also emphasizes the legal safeguards surrounding the exercise of this power, particularly the principle of legality, the presumption of innocence, the burden of proof, and the obligation to provide reasons for judgments, thereby ensuring the oversight of legality by higher courts.
In conclusion, the study asserts that the judge’s freedom in evaluating evidence constitutes a cornerstone of criminal proceedings, but it entails a great responsibility that requires reconciling public order imperatives with respect for human rights, in order to strengthen citizens’ trust in the justice system.
