Abstract
Study Summary
This thesis addresses the topic of “Administrative Servitudes Related to Water, Electricity, and Gas in Algerian Legislation”, in the context of the growing need to balance public interest requirements with guarantees for the protection of private property. Public authorities, in the exercise of their duties, may find it necessary to impose legal restrictions on private properties for the execution of public utility projects, without resorting to expropriation. This is primarily carried out through the mechanism of administrative servitudes.
The objective of this study is to highlight the legal framework governing these constraints, clarify their characteristics and categories, and specify the conditions under which they arise, while distinguishing them from civil law servitudes. The research also analyses the legislative and regulatory texts that govern public interventions in the areas of water, electricity, and gas, shedding light on the procedures for establishing such servitudes and the resulting legal effects, particularly regarding property owners’ rights and administrative powers.
The research is based on a central question: To what extent has the Algerian legislator succeeded in achieving a balance between public utility needs and private property protection in the regulation of administrative servitudes? This issue raises several sub-questions regarding the legal nature of these servitudes, the clarity of the governing texts, and the effectiveness of the legal safeguards offered to those affected.
The methodology employed is primarily analytical and descriptive, supported by comparative insights drawn from foreign legal systems, with a focus on laws and regulations related to water, electricity, and gas. The findings reveal a fragmented and often ambiguous legal framework, vague procedures, and inconsistent safeguards, which together create practical challenges in implementation.
Based on these findings, the thesis recommends the adoption of a unified and coherent legislative framework, providing a clear definition and classification of administrative servitudes, procedural guidelines for their implementation, and explicit protection of affected parties’ rights. It also advocates for revising property law provisions, strengthening the role of administrative courts in overseeing the legality of such measures, and enhancing the legal and technical capacities of the responsible public authorities.
