يتناول هذا البحث الأكاديمي موضوع "دور منظمات الإغاثة الدولية في النزاعات المسلحة"، من خلال دراسة حالة الهلال الأحمر الجزائري كنموذج تطبيقي في القضية الفلسطينية، لاسيما خلال العدوان الإسرائيلي المتكرر على قطاع غزة. ويستند البحث إلى خلفية معرفية وقانونية تجمع بين البعد الإنساني والبعد الحقوقي، في محاولة لفهم كيفية تدخل المنظمات الإنسانية غير الحكومية في النزاعات المسلحة، ضمن أطر القانون الدولي الإنساني والمبادئ الأساسية للعمل الإغاثي.

انطلقت الدراسة من إشكالية مركزية مفادها: إلى أي مدى يمكن اعتبار تدخل الهلال الأحمر الجزائري في القضية الفلسطينية نموذجًا فعالًا لعمل منظمات الإغاثة الإنسانية؟ وما مدى انسجام هذا التدخل مع أحكام ومبادئ القانون الدولي الإنساني؟ للإجابة عن هذه الإشكالية، اعتمدت الدراسة على المنهج الوصفي التحليلي، من خلال جمع المعطيات القانونية والوقائع الميدانية وتحليلها ضمن إطار نظري وواقعي.

تناولت الدراسة في فصولها عدة محاور أساسية، بدءًا بتأصيل الإطار المفاهيمي لمنظمات الإغاثة، مرورا بدراسة تطور اللجنة الدولية للصليب الأحمر ومركزها القانوني، وصولًا إلى تحليل المبادئ المنظمة للعمل الإنساني، مثل الحياد، الإنسانية، عدم التحيز، والاستقلال. كما خصّصت الدراسة حيزًا مهمًا للوقوف على آليات عمل اللجنة الدولية والقيود التي تعترضها في النزاعات، وكذلك التحديات التي تواجه الهلال الأحمر الجزائري في أداء مهامه داخل بيئة الصراع الفلسطيني-الإسرائيلي.

L’étude repose sur une base de connaissances à la fois juridique et humanitaire, visant à comprendre comment les organisations humanitaires non gouvernementales interviennent dans les conflits armés, dans le cadre du droit international humanitaire et des principes fondamentaux de l’action humanitaire. La recherche s’articule autour d’une problématique centrale : dans quelle mesure l’intervention du Croissant-Rouge algérien en faveur de la cause palestinienne peut-elle être considérée comme un modèle efficace d’action humanitaire ? Et dans quelle mesure cette intervention s’inscrit-elle dans le respect des normes et principes du droit international humanitaire ? Pour répondre à ces questions, l’étude adopte une méthodologie descriptive et analytique, en s’appuyant sur la collecte et l’analyse des données juridiques et factuelles, dans un cadre à la fois théorique et empirique. L’étude explore plusieurs axes fondamentaux, en commençant par la clarification conceptuelle des organisations humanitaires, puis l’analyse de l’évolution et du statut juridique du Comité international de la Croix-Rouge, avant de s’intéresser aux principes régissant l’action humanitaire, tels que la neutralité, l’humanité, l’impartialité et l’indépendance. Une attention particulière a été accordée aux mécanismes opérationnels du CICR ainsi qu’aux contraintes rencontrées dans les zones de conflit, en parallèle avec les défis spécifiques auxquels est confronté le Croissant-Rouge algérien dans le contexte du conflit israélo-palestinien.

Les résultats ont montré que le Croissant-Rouge algérien adhère relativement aux principes fondamentaux de l’action humanitaire et qu’il a réussi à acheminer une aide médicale et d’urgence aux Palestiniens malgré les obstacles politiques. Cela reflète un véritable engagement de solidarité, tant populaire qu’officielle, de l’Algérie envers le peuple palestinien. L’étude recommande de renforcer la coopération entre les organisations nationales et internationales, de réviser la législation nationale pour faciliter les missions de secours transfrontalières, d’assurer la protection juridique des volontaires algériens, et de documenter davantage les efforts nationaux dans le système du droit international humanitaire.

The research covers several essential axes, beginning with the conceptual foundation of relief organizations, then examining the evolution and legal status of the International Committee of the Red Cross, and finally analyzing the core principles that govern humanitarian work, such as neutrality, humanity, impartiality, and independence. Special attention is given to the operational mechanisms of the ICRC and the constraints it faces in conflict zones, alongside the specific challenges encountered by the Algerian Red Crescent in the Israeli-Palestinian conflict context.

The findings reveal that the Algerian Red Crescent relatively adheres to the fundamental principles of humanitarian action and has successfully delivered medical and relief assistance to Palestinians despite political obstacles. This reflects a genuine expression of Algerian solidarity—both popular and official—with the Palestinian people.
