تهدف هذه الدراسة إلى إبراز دور مبدأ الحيطة في حماية البيئة العمرانية في الجزائر، حيثيعد مبدأ الحيطة أحد أهم المبادئ المعتمد عليها في الاتفاقيات الدولية و التشريعات الداخلية للدول التي ترمي إلى تحقيق التنمية المستدامة، من خلال اتخاذ التدابير الممكنة واللازمة لتجنب وقوع الأضرارالجسيمة لمنع التدهور البيئي قبل حدوثه بتكلفة اقتصادية مقبولة، تتطلب الدراسة البحث في مدى تطبيق مبدأ الحيطة في: القوانين المنظمة للبيئة من خلال دراسة التأثير على البيئة والمراجعة البيئية و الخطر، في تسيير النفايات، في وضع مخططات الأخطار الطبيعية والتكنولوجية. وفي القوانين المنظمة للعمران من خلال إعماله في أدوات تهيئة الإقليم وأدوات التهيئة والتعمير. الكلمات المفتاحية: مبدأ الحيطة، البيئة العمرانية، التنمية المستدامة. Résumé : Cette étude vise à mettre en évidence le rôle du principe de précaution dans la protection de la législation nationale algérienne en matière d'environnement urbain visant à réaliser le développement durable en prenant les mesures possibles et nécessaires pour éviter les dommages graves afin de prévenir la dégradation de l'environnement avant qu'il ne se produise à un coût économique acceptable, L'étude nécessite des recherches sur l'application du principe de précaution dans les lois environnementales en examinant l'impact sur l'environnement, l'évaluation environnementale et le risque dans la gestion des déchets, dans le développement de systèmes d'aléas naturels et technologiques dans les lois régissant l'urbanisation par sa mise en œuvre dans les outils de préparation du territoire et les outils de préparation et de reconstruction. Summary: This study aims to highlight the role of the precautionary principle in protecting Algeria's urban environment s domestic legislation aimed at achieving sustainable development by taking possible and necessary measures to avoid serious damage to prevent environmental degradation before it occurs at an acceptable economic cost, The study requires research into the application of the principle of precaution in environmental laws by examining the impact on the environment, environmental review and risk in the management of waste, in the development of natural and technological hazard schemes in the laws governing urbanization through its implementation in the tools for the preparation of the Territory and the tools for preparation and reconstruction.
