أولى المشرع الجزائري في السنوات الأخيرة اهتماما كبيرا للمجال العمراني ومشاكله الذي يعد مجالا حساسا، وذلك من خلال تحديده لعدة آليات قانونية تعمل للحد من التجاوزات في حركة البناء والتوسع العمراني بصفة عامة، ويظهر ذلك من خلال فرض الرخص العمرانية، والمتمثلة في كل من رخصة التجزئة التي لها دور كبير في تنظيم عملية البناء في بدايتها، ورخصة البناء التي تعطي الشرعية القانونية للتشييد والبناء، بالإضافة إلى رخصة الهدم التي لها دور وقائي وعقابي في نفس الوقت، وتقييد هذه الرخص بجملة من الإجراءات، فهو يهدف من وراء ذلك إلى ضمان احترام قواعد التهيئة والتعمير ومراقبة النشاطات العمرانية والحفاظ على النظام العام العمراني. الكلمات المفتاحية: الرخص العمرانية، رخصة الهدم، قواعد التهيئة والتعمير. Summary: In recentyears, the Algerian legislator has paidgreat attention to the urbanfield and itsproblems, whichisconsidered a sensitive field, by specifyingseverallegalmechanismsthatwork to limit violations in the construction movement and urban expansion in general, and thisappearsthrough the imposition of urbanpermits, represented by: The retaillicense, which has a major role in regulating the construction processatitsbeginning, and the building permit, whichgiveslegallegitimacy to construction and building, in addition to the demolitionlicense, which has a preventive and punitive roleat the same time, and restrictingtheselicenses to a set of procedures, is the goal behindthis. Résumé: Ces dernières années, le législateur algérien a accordé une grande attention au domaine urbain et à ses problèmes, considéré comme un domaine sensible, en précisant plusieurs mécanismes juridiques qui visent à limiter les violations dans le mouvement de construction et l'expansion urbaine en général, et cela se manifeste à travers l'imposition de permis d'urbanisme, représentés par : Le permis de vente au détail, qui joue un rôle majeur dans la régulation du processus de construction à son début, et le permis de construire, qui donne une légitimité juridique à la construction et à la construction, en plus du permis de démolition, qui a un rôle à la fois préventif et punitif, et limiter ces autorisations à un ensemble de procédures, tel est l'objectif de garantir le respect des règles d'aménagement et de reconstruction, de surveiller les activités urbaines et de maintenir l'ordre public urbain.
