Abstract

Description

Study summary: The real protection of human rights begins with the domestic judicial system, meaning it is carried out through national judiciary, bodies, and institutions of the state. If these national institutions fail to protect human rights, then the role of international institutions and bodies comes into play to fulfill this task, and the door to resorting to them for the protection of human rights becomes open. The Organization of African Unity (OAU) previously worked on establishing an African system for the protection of human rights and peoples on the African continent. This was embodied in the adoption of the African Charter on Human and Peoples' Rights in 1981. The charter introduced a mechanism for monitoring and supervising the enforcement and enhancement of rights and freedoms guaranteed under its provisions, namely the African Commission on Human and Peoples' Rights. Furthermore, the organization later developed protection mechanisms by adopting the 1998 Protocol to the African Charter, which established the African Court on Human and Peoples' Rights for better oversight of the necessary protection of human rights and fundamental freedoms in Africa.
