تطرق هذا البحث لدراسة إحدى أهم وأبرز المواضيع الحديثة والمعاصرة، ألا وهو موضوع المسؤولية الجزائية لمقدمي خدمات الإنترنت، وهو من الأهمية بما كان لتخصيص كتب ومجلدات بشأنه لا الاكتفاء ببحث من صفحات معدودة حوله، وقد تناولت الدراسة بداية الإطار الموضوعي للمسؤولية الجزائية لمقدمي خدمات الإنترنت بدءا من تحديد تعريفاتهم القانونية والفقهية وكذا الالتزامات المفروضة على عاتقهم والتعريج على مختلف الجرائم التي قد ترتكب من قبلهم، وتبيان مدى خصوصيتها وتمييزها عن الجرائم العادية، وصولا إلى مختلف الإجراءات المستحدثة التي عمل المشرع الجزائري على إيجادها بهدف تمكين رجال التحري والتحقيق من متابعتها، وملاحقة مرتكبيها وتسليط العقاب عليهم منذ مرحلة البحث والتحري ومرورا على مرحلة التحقيق الابتدائي إلى غاية الوصول لمرحلة المحاكمة، التي خص لها المشرع هيئة قضائية مستحدثة وهي القطب الجزائي الوطني لمكافحة الجرائم المتصلة بتكنولوجيات الإعلام والاتصال، ثم تبيان كافة العقوبات الأصلية والتكميلية المسلطة عليهم وأسباب الإعفاء من المسؤولية التي قد يستفيدون منها. الكلمات المفتاحية: مقدمو خدمات الإنترنت، المسؤولية الجزائية، القطب الجزائي الوطني. Abstract : This research addresses one of the most important and prominent modern and contemporary topics, namely The criminal Liability of Internet Service Providers. It is of such importance that it warrants the dedication of books and volumes, rather than being confined to a few pages. The study initially explores the substantive framework of The Criminal Liability of Internet Service Providers, beginning with the identification of their legal and jurisprudential definitions, as well as the obligations imposed upon them. It then delves into the various crimes that may be committed by them, highlighting their distinct nature and how they differ from traditional crimes. The study also examines the various new procedures that the Algerian legislator has introduced to enable law enforcement officers to monitor and pursue perpetrators and impose penalties on them, starting from the investigation and search phase, through the preliminary investigation phase, and culminating in the trial phase. The legislator has established a new judicial body, The National Penal Pole for combating crimes related to information and communication technologies, to handle these cases. Additionally, the study outlines all the principal and supplementary penalties imposed on them and the grounds for exemption from liability that The Internet Service Providers might benefit from. Résumé : Cette recherche a abordé l'étude de l'un des sujets modernes et contemporains les plus importants et les plus marquants, à savoir la question de La Responsabilité Pénale des Fournisseurs de Service Internet. Il est si important que des livres et des volumes y soient consacrés, et non seulement quelques pages de recherche à ce sujet. L'étude a traité du début du cadre objectif de Responsabilité des Fournisseurs de Service Internet, en commençant par définir leurs définitions juridiques et jurisprudentielles, ainsi que les obligations qui leur sont imposées, en passant en revue les différents délits qui peuvent être commis par eux, en précisant l'étendue de leur spécificité et en les distinguant des délits ordinaires, jusqu'aux différentes procédures Nouvelles que le législateur Algérien s'est efforcé de créer dans le but de Responsabilité les hommes en matière d'enquête, en passant par la phase d'enquête préliminaire, jusqu'à la phase du procès, pour laquelle le législateur a attribué un nouvel organe judiciaire, qui est le Pole PénalNational, pour lutter contre les délits, liés aux technologies de l'information et de la communication, puis clarifier toutes les sanctions initiales et complémentaires qui leur imposent, ainsi que les motifs d'exonération de responsabilité dont ils peuvent bénéficier.
