آليات مكافحة جريمة تقليد أختام الدولة والدمغات في التشريع الجزائري

Abstract

تعتبر جريمة تقليد اختام الدولة والدمغات من اهم الموضوعات في قانون العقوبات الجزائري ومن أخطر الجرائم التي تخل بالثقة العامة، فهي جريمة قوامها العبث في الختم الصحيح والدمغة الصحيحة وهذا بإحداث تغيير في محتواهما، وقد أورد المشرع الجزائري هذه الجريمة في القسم الثاني من الفصل السابع تحت عنوان التزوير، وهذا في المواد من 205 إلى 213 من ق ع ج، ففعل التقليد يعد جريمة لها خصوصياتها من حيث مصلحة المعتدى عليها ومن حيث خطورة النتائج المترتبة منها، وبذلك اوجب لها اشد العقوبات كما ان هذه الجريمة شأنها شأن الجرائم الأخرى، لها قواعدها الموضوعية التي تقوم عليها والتي تتضمن أركانها العامة، الركن المادي والمتمثل في محل التقليد وتغيير الحقيقة في الختم والدمغة الاصليان، وركنها المعنوي والمتمثل في القصد العام والقصد الخاص، كما تتطلب وسائل حديثة لأجل كشفها. تجدر الإشارة الى ان متابعة هذه الجريمة تخضع للقواعد المقررة في قانون الإجراءات الجزائية حيث تبدأ بمرحلة البحث والتحري بجميع مراحلها وتنتهي بصدور حكم فاصل في القضية. الكلمات المفتاحية: جريمة تقليد اختام الدولة والدمغات، قانون العقوبات الجزائري، القصد العام والقصد الخاص. Summary : The crime of counterfeiting state seals and imprints is considered one of the most important topics in the Algerian penal code and one of the most serious crimes that violate public trust. It is a crime based on tampering with the correct seal and imprint by causing a change in their content. The Algerian legislator mentioned this crime in the second section of Chapter Seven under the title Forgery, and this is in Articles 205 to 213 of the QAG. The act of imitation is considered a crime that has its own characteristics in terms of the interest of the victim and the seriousness of the consequences resulting from it, and thus requires the most severe penalties for it. Also, this crime, like other crimes, has its objective rules upon which it is based, which include its general elements, the material element, which is represented by the place of imitation and changing the truth in the original seal and imprint, and its moral element, which is represented by general intent and specific intent. It also requires modern means in order to detect it. It should be noted that the prosecution of this crime is subject to the rules stipulated in the Code of Criminal Procedure, as it begins with the research and investigation stage in all its stages and ends with the issuance of a decisive ruling in the case. résumé Le délit de contrefaçon des sceaux et empreintes de l'?tat est considéré comme l'un des sujets les plus importants du code pénal algérien et l'un des délits les plus graves qui portent atteinte à la confiance du public. Il s'agit d'un délit basé sur la falsification du sceau et de l'empreinte corrects en provoquant une modification dans leur contenu. Le législateur algérien a mentionné ce délit dans la deuxième section du chapitre sept sous le titre de faux, et ce, aux articles 205 à 213 du QAG. L'acte d'imitation est considéré comme un délit qui présente ses caractéristiques propres en termes de l'intérêt de la victime et la gravité des conséquences qui en résultent, et requiert donc les sanctions les plus sévères. En outre, ce crime, comme les autres crimes, a ses règles objectives sur lesquelles il se fonde, qui incluent ses éléments généraux, l'élément matériel, qui est représenté par la place de l'imitation et du changement de la vérité dans le sceau et l'empreinte originale, et son l'élément moral, qui est représenté par l'intention générale et l'intention spécifique, et qui nécessite également des moyens modernes pour le détecter. Il convient de noter que la poursuite de ce délit est soumise aux règles énoncées dans le Code de procédure pénale, car elle commence par la phase de recherche et d'enquête à toutes ses étapes et se termine par le prononcé d'une décision décisive dans l'affaire.
