مكانة رئيس الجمهورية في ظل التعديل الدستوري 2020

Abstract

يكتسب منصب رئيس الجمهورية مكانة مرموقة وأهمية بارزة في الحياة الدستورية والسياسية للأمة ،نظرا لدوره الهام ومركزه السامي في الدولة عموما وباعتباره منتخبا عن طريق الإقتراع العام المباشر فقد احتل مكانة ممتازة وباعتباره ايضا رئيسا للدولة ومجسدا لوحدة الأمة وهو المسؤول الأول عن وحدة التراب الوطني والسيادة الوطنية ،وقد منح الدستور الجزائري لرئيس الجمهورية سلطة التشريع بأوامر ،إلا أن هذه السلطة قيدها المؤسس الدستوري بعدة قيود لا سيما خضوع الأوامر لرقابة المحكة الدستورية وكذا البرلمان . الكلمات المفتاحية : منصب رئيس الجمهورية , سلطة التشريع بأوامر , رقابة المحكمة الدستورية Abstract: the fonction of the president of the republic is of great importance in the political and constitutional life on the nation , given its important role and its hight status in the state in general ,As the prisident in Algeria was elected by direct universal suffrage, he occupied excellent position in the algerian political system as head of state،the algerian constitution grants the president the power to legislate by orders ,this power has been restricted by the constitutional etablisment with serval restructions .especially the subordination of orders to the over sight of the constitutional court and parliament. Résumé : La fonction de président de la République acquiert un statut prestigieux et une importance primordiale dans la vie constitutionnelle et politique de la nation, compte tenu de son rôle important et de sa position élevée dans l'état en genéral. Comme il a été élu au suffrage public direct , il a occupé une excellente position de chef de l'état et une incarnation de l'unité de la nation .Il est le premier responsable de l'unité du territoire national et de la souveraineté national .Il a la constitution algérienne a accordé au président le pouvoir de légiférer par arrêtés, mais ce pouvoir a été restreint par le fondateur de la Constitution avec plusieurs restrictions, notamment la soumission des ordonnances au contrôle de la cour constitutionnelle ainsi qu'au parlement.
