الحماية الجنائية لعمالة الأطفال في قانون العقوبات وقانون حماية الطفل 12/15

Abstract

عملت مختلف الدول جاهدة على القضاء على ظاهرة عمالة الأطفال عن طريق تكليفه بعمل يعرض سلامته ،و صحته أو رفاهيته للخطر،فتعتبر ظاهرة عمل الأطفال ظاهرة عالمية بدأت تنتشر و تتوسع في الآونة الأخيرة و تترك أثارا سلبية تنعكس على الطفل بشكل خاص،وعلى الأسرة و المجتمع بشكل عام،ومن بين هذه الدول نجد سعي المشرع الجزائري المستمر على وضع آليات قانونية للوقاية من هذه الظاهرة،وقمعها خاصة بعد صدور قانون حماية الطفل . فالمجتمعات حول العالم تعاني من ظاهرة تشغيل الأطفال التي تسمى بعمالة الأطفال خاصة دول عالم الثالث،مما دفع بالمجتمع الدولي لتدخل من خلال منظمات و هيئات دولية لتنظيم عمل الأطفال ،و نظرا لحرص الجزائر على محاربة ظاهرة عمالة الأطفال،والوقاية منها صادقت على اتفاقية منظمة العمل الدولية ،و كذا اتفاقية الأمم المتحدة حول حقوق الطفل و اتخذت مجموعة من الإجراءات لتجسيد محتوى الاتفاقيات و كرستها في منظومتها القانونية لمنع كل أشكال تشغيل الأطفال ما لم يحظى تشغيلهم بتأطير قانوني،يحدد الشروط التي يجب إن تحيط تشغيلهم .

Summary: Various countries have worked hard to eliminate the phenomenon of childlabor by assigninghim to workthatendangershissafety, health or well-being. The phenomenon of childlaborisconsidered a global phenomenonthat has begun to spread and expand in recent times and leavesnegativeeffectsthat are reflected on the child in particular, and on the family and society. In general, and amongthese countries, wefind the Algerian legislator'scontinuousendeavor to developlegalmechanisms to prevent and suppressthisphenomenon, especiallyafter the issuance of the Child Protection Law. Communitiesaround the world sufferfrom the phenomenon of childlabor, whichiscalledchildlabor, especially in third world countries, whichprompted the international community to intervenethrough international organizations and bodies to regulatechildlabor. As well as the United Nations Convention on the Rights of the Child, and ittook a set of measures to embody the content of the agreements and enshrinedthem in itslegal system to prevent all forms of childlaborunlesstheiremployment has a legalframeworkthatdefines the conditions that must surroundtheiremployment.

Résumé: Divers pays ont travaillé dur pour éliminer le phénomène du travail des enfants en l'affectant à des travaux qui mettent en danger sa sécurité, sa santé ou son bien-être.Le phénomène du travail des enfants est considéré comme un phénomène mondial qui a commencé à se propager et à s'étendre ces derniers temps et laisse effets négatifs qui se répercutent sur l'enfant en particulier, et sur la famille et la société En général, et parmi ces pays, on retrouve l'effort continu du législateur algérien pour développer des mécanismes juridiques pour prévenir et réprimer ce phénomène, surtout après la promulgation de l'arrêté Loi sur la protection de l'enfance.
