Abstract

السلطة التنظيمية لرئيس الجمهورية في ضل التعديل الدستوري2020 ملخص أقر المؤسس الدستوري الجزائري لرئيس الجمهورية وفقا للمادة 141/1 من التعديل الدستوري2020 بصلاحية ممارسة السلطة التنظيمية في المسائل غير المخصصة للبرلمان، مانحا له بذلك مجالا واسعا غير محدد يمارس من خلاله اختصاصه التنظيمي، وبالمقابل حصر المؤسس الدستوري مجال البرلمان بتحديد الميادين التي يمكن أن يشرع بها التي نجد أساسها في المادتين 139 و140 من التعديل الدستوري 2020 ومواد أخرى متفرقة في الدستور، وهذا ما جعل السلطة التنظيمية لرئيس الجمهورية آلية دستورية مدعمة لمركز لرئيس الجمهورية في مواجهة البرلمان في مجال صنع القانون، كذلك منح الدستور لرئيس الجمهورية كل الوسائل الدستورية التي يستطيع من خلالها السيطرة والتشريع حتى في المجال المخصص للبرلمان، لكن إطلاق سلطته التنظيمية هذا لا يعني عدم خضوعها للرقابة، فإن كلا من التنظيم والقانون يخضعان للرقابة الدستورية وفقا للمادة 190 من التعديل الدستوري 2020، هذا ما يجعل هذا الأخير حريص على تأمين السلطة التنظيمية لرئيس الجمهورية، وفي نفس الوقت مراقبا السلطة التنظيمية من تعديها على مجال القانون. Le résumé: Le fondateur constitutionnel algérien approuvé au président de la république selon l'article 141/1 de l'amendement constitutionnel en 2020 l'autorité d'exercer le pouvoir réglementaire dans les domaines non attribuées à la loi, en lui donnant ainsi un demain très vaste pour exercer ses attributions, d'autre parte, la constitution a limité les attributions du pouvoir législative (les articles 139 et 140 et d'autres articles répartis dans la constitution), ainsi donc le président de la réglementaire se trouve dans une position favorable par rapport au parlement, cette position est réconfortée aussi pat le rôle du président de la république dans l'élaboration des lois, vu que le pouvoir réglementaire a son propre domaine indépendant de la loi, il est soumis donc au contrôle du conseil constitutionnel( selon l'article 190 de l'amendement constitutionnel en 2020 ) en cas d'empiétement sur un autre domaine, ce qui permet à ce dernier de protéger le pouvoir réglementaire du dépassement de la loi, et en même temps de contrôler les règlement indépendant des empiétement sur le domaine de la loi.

Summary : The Algerian constitution al founder approved the President of the Republic according to Article 141/1 of the Constitutional Amendment in 2020 the authority to exercise regulatory power in areas not attributed to the law, thus giving him a very broad tomorrow to exercise his powers, on the other hand, the constitution has limited the powers of the legislative power (Articles 139 and 140 and other articles distributed in the constitution), so the president of the regulatory is in a favorable position compared to the parliament, this position is also comforted by the role of the President of the Republic in the development of laws, since the regulatory power has its own domain independent of the law, it is therefore subject to the control of the Constitutional Council (according to Article 190 of the Constitutional Amendment in 2020) in the event of encroachment on another domain, which allows the latter to protect the regulatory power from exceeding the law, and at the same time to control the independent regulations of encroachment on the domain of the law.
