| dc.description | تتمثل خصوصية احكام الاشتراك في الجريمة المعلوماتية في التشريع الوطني ان المشرع الجزائريمن خلال نص المادة 394 مكرر 5 ق ع جرم الاشتراك في مجموعه او في اتفاق بهدف العداد لجريمةمن جرائم الاعتداء على نظم المعالجة آلية للمعطيات، واخضاع الاعمال التحضيرية التي تسبق البدء فيالتنفيذ لعقوبة اذا تمت في شكل مستثني بذلك العمال التحضيرية المرتكبة من طرف شخص، واحد كماجرم الاشتراك في الاتفاق مقررا له نفس عقوبة الجريمة المتفق على ارتكابها وكذا الشروع فيها مشدداالعقوبة في حاله تعدد الجرائم التي تم تحضير لها، اين تم دراسة مقدمو الخدمات كنموذج الاشتراك اين تم التنصيص عليه في المادة اثنين من القانون 04-09 المتعلق بجرائم تكنولوجيا العالم والاتصال الذي اليمكن مسائلته كشريك بعد ثبوت قيامه بأفعال الاشتراك وصوره المتمثلة في المساهمة بتقديم المساعدةفي الجريمة، المر الذي يتضح معه ان المشرع الجزائري هذا استوحى احكام الاشتراك من الاتفاقيةالدولية بودابيست. الكلمات المفتاحية: احكام الاشتراك في الجريمة المعلوماتية، المعالجة آلية للمعطيات، القانون 04-09، بجرائم تكنولوجيا العالم والاتصال. Résumé: La particularité des dispositions de la participation à la délinquance informatique dans la législation nationale est que le législateur algérien, à travers le texte de l'article 394 bis 5 du Code, incrimine la participation à un groupement ou à un accord en vue de préparer un délit d'attaque automatique. systèmes de traitement de données, et soumettre les travaux préparatoires qui précèdent le début du délit à l'exécution d'une peine si elle est effectuée sous une forme qui exclut le travail préparatoire commis par une seule personne, ainsi que le délit de participation à l'accord.
