Abstract
General summary about the memorandum:
Through our study of this topic, it turned out that the Algerian Legislature has granted some exceptional powers to judicial police officers, especially with regard to the cases of dressing up and judicial authorization, but it has defined it by rules and regulatory frameworks and control over practitioners of the status of judicial officers, since these powers and tasks affect the rights and dignity of persons, such as the duties of judicial police officers in case of confusion and the tasks to be performed in that case were introduced, while also touching upon the powers and powers vested in judicial police officers in case of confusion, in addition to addressing the exceptional competencies of judicial police officers within the framework of the judicial power of attorney in terms of the tasks and actions assigned to judicial police officers within the framework of the judicial power of attorney, defining the concept of the judicial power of Attorney, its objectives and characteristics, with touching upon the conditions of validity of the judicial power of attorney as well as the legal implications arising from it due to the fact that the investigation is not the prerogative of judicial police officers.
However, due to the continuous and frightening development of various types of crimes that threaten the security and stability of the state on the one hand, and the entire spectrum of society on the other, in addition to the acumen that has become characteristic of the perpetrators of such crimes, it has become clear that the Algerian Legislature has kept pace with this development, through the enactment and inclusion of legal articles the controlled extradition procedure, which judicial officers can resort to in some crimes identified exclusively by the Algerian legislature, supported by the traditional methods adopted earlier, or this in order to tighten the noose on those crimes, where the legislator deliberately allowed judicial officers to exercise some powers that directly affect the freedom and rights of the individual, while strengthening control over them and obliging them to.
