القضاء الجنائي بين تسبيب الأحكام الجزائية والاقتناع الشخصي لقاضي الحكم

Abstract

مذكرتي بعنوان القضاء الجنائي بين تسبيب الأحكام الجزائية و الاقتناع الشخصي لقاضي الحكم ؛ تناولت فيها بالدراسة تسبيب الأحكام الجزائية من جهة ، و الذي توصلت من خلاله إلى أن التسبيب يكون مفصلا في الجنح و المخالفات ؛ و يكون عاما في الجنايات ؛ و تناولت فيها أيضا الاقتناع الشخصي لقاضي الحكم ، و الذي توصلت فيه إلى أن المشرع الجزائري أقر الاقتناع الشخصي للقاضي في محكمة الجنايات فقط ؛ دون محكمة الجنح و المخالفات .. الكلمات المفتاحية: القضاء الجنائي ؛ تسبيب الأحكام الجزائية ، الاقتناع الشخصي . Abstract: My memorandum entitled Criminal Justice between the Reasoning of Criminal Judgments and the Personal Conviction of the Sentencing Judge, in which I studied the reasoning of criminal judgments on the one hand, through which I concluded that causation is detailed in misdemeanours and violations, and is general in felonies, and also dealt with the personal conviction of the sentencing judge, in which I concluded that the Algerian legislator approved the personal conviction of the judge in the Criminal Court only, without the Misdemeanours and Violations Court. Résumé : Mon mémorandum intitulé Justice pénale entre le raisonnement des jugements pénaux et la condamnation personnelle du juge qui a prononcé la peine, dans lequel j'ai étudié le raisonnement des jugements pénaux d'une part, par lequel j'ai conclu que la causalité est détaillée dans les délits et les violations, et est générale dans les crimes, et traitait également de la condamnation personnelle du juge qui a prononcé la peine, dans lequel j'ai conclu que le législateur algérien a approuvé la condamnation personnelle du juge devant le tribunal pénal uniquement, sans le tribunal des délits et des violations .
