Abstract: Judicial police constitute one of the fundamental pillars of the Algerian justice system. They are entrusted with carrying out preliminary procedures for criminal investigations and collecting evidence, under the supervision and oversight of the judiciary, represented by the public prosecution and the investigating magistracy. The importance of this relationship lies in striking a balance between ensuring the effectiveness of criminal investigations and safeguarding individual rights and freedoms. The relationship between the judicial police and the judiciary is defined by the former acting as an auxiliary body that operates under the judiciary’s guidance. It does not possess full independence in performing its duties, but rather functions under the orders and instructions of the public prosecutor, who directs and monitors the investigation process. Judicial police officers are also subject to dual oversight—administrative on one hand and judicial on the other—to ensure proper performance of their duties and adherence to legal procedures. This relationship reflects the complementary nature between the judicial police and the judiciary, as coordination between the two enhances judicial efficiency, limits abuses, and strengthens public trust in the justice system. Nevertheless, legal and institutional challenges remain, particularly with regard to clearly defining the respective powers of each authority and ensuring the independence of the judiciary while maintaining the efficiency of the judicial police. In conclusion, strengthening the relationship between the judicial police and the judiciary requires legislative and training reforms that clarify responsibilities and reinforce respect for human rights within the framework of criminal justice.
