Abstract

ملخص باللغة العربية العنوان: لوائح الضبط الإداري بين الحفاظ على النظام العام وضمان الحريات العامة تتناول هذه الدراسة وظيفة الضبط الإداري كإحدى أهم وظائف الدولة، حيث تسعى من خلالها الإدارة إلى المحافظة على النظام العام بأبعاده المختلفة (الأمن، الصحة، السكينة العامة)، مع احترام الحريات العامة المكفولة دستوريا. تهدف الدراسة إلى تسليط الضوء على التوازن المطلوب بين السلطة التي تمارسها الإدارة لضبط النشاطات داخل المجتمع وبين ضرورة احترام حقوق الأفراد، وقد تم التركيز على الجوانب القانونية والمؤسساتية التي تضبط هذا التوازن، مع التطرق لحالة الظروف الاستثنائية والأزمات التي تستدعي توسيع صلاحيات الضبط على حساب الحريات. اعتمدت الدراسة عل المنهج التحليلي الوصفي لتوضيح الإشكالية الرئيسية، كما تم التطرق لمختلف الهيئات المكلفة بالضبط ووسائلها، وكذا مظاهر التقييد المسموح بها في إطار الشرعية القانونية. Titre : Le Pouvoir de Police Administrative entre le Maintien de l’Ordre Public et la Garantie des Libertés Publiques Ce mémoire traite de l’équilibre nécessaire entre le pouvoir de police administrative et la protection des libertés publiques dans le cadre juridique algérien. La police administrative représente une fonction essentielle de l’État visant à assurer l’ordre public — à travers la sécurité, la santé et la tranquillité publique — tout en veillant à ce que les restrictions imposées aux libertés individuelles soient justifiées par la loi et restent proportionnées. L’étude examine comment les autorités publiques exercent ce pouvoir réglementaire, notamment en période de crise, et comment cet exercice peut menacer les droits fondamentaux s’il n’est pas encadré. À travers une analyse juridique et descriptive, le travail met en lumière les enjeux liés à l’organisation et au fonctionnement de la police administrative ainsi que les mécanismes garantissant un juste équilibre entre ordre public et droits constitutionnels. Title: Administrative Policing Between the Maintenance of Public Order and the Guarantee of Public Freedoms This research explores the delicate balance between administrative policing and individual freedoms in the framework of Algerian law. Administrative policing is a critical function of the state aimed at preserving public order—through security, health, and public tranquility—while ensuring that restrictions on individual liberties are legally justified and proportionate. The study discusses how public authorities exercise regulatory powers, especially in times of crisis, and how these powers can potentially infringe on public freedoms if not properly supervised. Through a legal and analytical approach, the thesis examines both the organizational and functional aspects of administrative policing and identifies mechanisms to maintain the necessary balance between public order and the protection of constitutional rights.
