Abstract
Summary:
This memorandum studies and analyzes the subject of "the concession contract in industrial real estate under Investment Law No. 22-18", as one of the modern contractual mechanisms adopted by the Algerian state to facilitate the allocation of land to investors, moving away from direct ownership practices that had previously led to real estate speculation and the depletion of state-owned property.
The concession contract emerged as a legal mechanism granting the investor the right to use industrial real estate for a defined period, in return for the actual implementation of an investment project, while the land remains the property of the state. This system seeks to strike a balance between preserving national assets and creating an attractive and stimulating environment for investment.
The memorandum focused on the conceptual and regulatory frameworks of the concession contract, highlighting its administrative nature and the features that distinguish it from other contracts. It outlined the conditions for its conclusion, the main stakeholders involved, especially the Directorate of State Property and the National Agency for Industrial Land, in addition to the obligations of the parties and the legal guarantees for proper implementation.
The study also addressed the strict oversight exercised by competent authorities over investors, showing how the state activates its right to withdraw the concession in cases of non-compliance with the agreed conditions. Moreover, it shed light on the various types of disputes that may arise in connection with this contract, whether administrative or judicial, and the mechanisms for resolving them.
The memorandum concluded with a set of findings and recommendations calling for the effective implementation of the legal texts governing this system, updating practical frameworks, harmonizing the involved entities, and simplifying procedures to ensure greater efficiency of real estate concession contracts, thereby contributing to the enhancement of economic development and achieving the state’s goals in promoting productive and sustainable investment.
