Abstract

أثر استخدام الطائرات المسيّرة على القانون الدولي العام والامتثال لقواعده من إعداد الطالبتان نجمة الأوا نسرين هديل فدوى الملخص: أبرزت هذه الدراسة كيف أثّر استخدام الطائرات المسيّرة (الدرونز) على مبادئ وقواعد القانون الدولي العام، خاصة في مجالي المسؤولية الدولية وتنظيم استخدام القوة، وقد تناول البحث الجوانب القانونية المرتبطة بتعريف هذه الطائرات، وطبيعة استخدامها، والإطار القانوني الذي يحكم تشغيلها في ظل قواعد الطيران المدني الدولي، لاسيما تلك التي تصدرها منظمة الطيران المدني الدولي (الإيكاو). كما استعرضت الدراسة دور المنظمات الدولية الحكومية، مثل منظمة الأمم المتحدة وهيئاتها المختلفة، من مجلس الأمن والجمعية العامة ومجلس حقوق الإنسان، في مناقشة التحديات القانونية والأمنية التي تطرحها هذه التكنولوجيا الحديثة، وتطرقت الدراسة أيضًا إلى مساهمات المنظمات غير الحكومية في مراقبة استخدام هذه الطائرات، خاصة في النزاعات المسلحة، وتقييم مدى احترام الدول للقانون الدولي الإنساني وحقوق الإنسان، وسعت الدراسة إلى تحليل المسؤولية الدولية المترتبة على استخدام الطائرات المسيّرة، سواء في سياقات النزاع المسلح أو في عمليات مكافحة الإرهاب، مع التركيز على التحديات المرتبطة بالامتثال، والمساءلة، وشفافية العمليات. الكلمات المفتاحية: الطائرات المسيّرة، القانون الدولي العام، المسؤولية الدولية، الطيران المدني، منظمة الإيكاو، الأمم المتحدة، حقوق الإنسان، النزاعات المسلحة، المنظمات غير الحكومية. Abstract: This study highlights the impact of the use of unmanned aerial vehicles (UAVs), or drones, on the principles and rules of public international law, particularly in the areas of international responsibility and the regulation of the use of force. The research addresses the legal aspects related to the definition of drones, their nature of use, and the legal framework governing their operation under international civil aviation law, especially as issued by the International Civil Aviation Organization (ICAO). The study also reviews the role of international governmental organizations such as the United Nations and its bodies—namely the Security Council, the General Assembly, and the Human Rights Council—in discussing the legal and security challenges posed by this modern technology. Additionally, the research examines the contributions of non-governmental organizations in monitoring drone use, especially in armed conflicts, and assessing the extent to which states comply with international humanitarian law and human rights standards. The study seeks to analyze the international responsibility arising from the use of drones, whether in the context of armed conflict or counter-terrorism operations, with a focus on challenges related to compliance, accountability, and operational transparency.
