Abstract

الملخص: تُسلّط هذه المذكرة الضوء على مخطط شغل الأراضي بوصفه أداة قانونية وتقنية تهدف إلى تنظيم استعمالات الأرض وضبط البناء ضمن رؤية عمرانية متكاملة. وقد تناول المبحث التمهيدي الإطار المفاهيمي لهذا المخطط وعلاقته بأدوات التهيئة الأخرى، في حين خُصص الفصل الأول لدراسة الإجراءات القانونية والتقنية المعتمدة في إعداده. أما الفصل الثاني، فقد ركّز على أثره في تنظيم الرخص والشهادات العمرانية، كآليات لضبط البناء. وخلصت الدراسة إلى أن فاعلية مخطط شغل الأراضي تظل مرهونة بتجسيد أحكامه على أرض الواقع، وتعزيز التنسيق بين الفاعلين المحليين لتحقيق تنمية حضرية متوازنة ومستدامة. الكلمات المفتاحية : مخطط شغل الأراضي ، الرخص و الشهادات ، التهيئة والتعمير Abstract: This thesis sheds light on the Land Occupation Plan (Plan d’Occupation des Sols – POS) as a legal and technical tool aimed at regulating land use and controlling construction within an integrated urban vision. The introductory section explores the conceptual framework of this plan and its relationship with other planning instruments, while the first chapter is devoted to studying the legal and technical procedures involved in its preparation. The second chapter focuses on its impact in organizing permits and urban planning certificates as mechanisms for construction control. The study concludes that the effectiveness of the Land Occupation Plan remains contingent upon the concrete implementation of its provisions on the ground and the reinforcement of coordination among local stakeholders to achieve balanced and sustainable urban development. Résumé : Ce mémoire met en lumière le Plan d’Occupation des Sols (POS) en tant qu’outil juridique et technique visant à organiser l’usage des sols et à encadrer la construction dans une vision urbanistique intégrée. La partie introductive explore le cadre conceptuel de ce plan ainsi que sa relation avec les autres instruments d’aménagement. Le premier chapitre est consacré à l’étude des procédures juridiques et techniques relatives à son élaboration, tandis que le second analyse son impact à travers la régulation des permis et certificats d’urbanisme. L’étude conclut que l’efficacité du POS dépend de l’application concrète de ses dispositions sur le terrain et du renforcement de la coordination entre les acteurs locaux en vue d’un développement urbain équilibré et durable.
