جريمة خيانة الأمانة في التشريع الجزائري

Abstract

تعتبر جريمة خيانة الأمانة من بين الجرائم التي علجها المشرع الجزائري في نص المادة 376 من قانون العقوبات الجزائري، نظرا للخطورة التي تلحقها هذه الجريمة سواء على الذمة المالية للأشخاص أو المساس بمبادئ التي يرتكز عليها المجتمع، و من أهمها أداء اداء الأمانات إلى أهلها، لذلك فإن المشرع الجزائري اقر لهذه الجريمة مجموعة من الإجراءات الخاصة، بالإضافة إلى العقوبات ملحقة لها، حماية لمصالح الأشخاص من خلال توفير الحماية القانونية لهم. The crime of breach of trust is considered among the crimes dealt with by the Algerian legislator in the text article 376 of the Algerian penal code. Which was inflicted by this crime, weather on the financial disclosure of persons or prejudice to the principles upon which society is based, the most important of which is the performance of trusts to their people. therefore, the Algerian legislator approves for this crime a set of special procedures in addition to the penalties attached to this crime are to protect the interests of people by providing them with legal protection. Le délit d'abus de confiance figure parmi les délits vises par le législateur algérien dans le texte de l'article 376 du code pénalalgérien et cela et duà la gravité cause par crime qu'il s'agisse de la divulgationfinancière des personnes ou de la violation des principes sur lesquels la société est fondée, dont le plus important est l'exécution des fiducies envers les personnes. Et il a approuvé pour ce crime un ensemble de procédures spéciales en plus de peines attachées à ce crime afin de protéger les intérêts des personnes en leur Assurant une protection légale
