This thesis addresses the issue of the Algerian judge’s application of international treaties, through an analytical and doctrinal study that combines the constitutional framework, the national legal system, and judicial practice. The research begins with a central question: To what extent is the national judge bound by the provisions of ratified international treaties? And what are the limits of his authority in implementing and interpreting them within the Algerian judicial system? In this regard, the first chapter outlines the theoretical framework of treaties, starting from their definition, types, and stages of conclusion, up to the position of the Algerian constitutional legislator, highlighting that the Constitution requires formal ratification and publication in the Official Gazette for a treaty to acquire legal force. It also affirms the supremacy of ratified treaties over domestic law, provided they have entered into force. The second chapter is devoted to studying the judge’s role in applying treaties, showing that judges face several practical challenges, including issues of interpretation, a lack of specialized training in international law, and the absence of institutional mechanisms to support treaty implementation. The study refers to key rulings by the Algerian Supreme Court, most notably Decision No. 167921 of 2000, which affirmed the primacy of an international convention on drug control, as well as a 2022 judgment reflecting a more proactive judicial stance. A comparison is made with French jurisprudence, especially the Nicolo (1989) and GISTI (1990) rulings, which granted administrative judges the power to interpret treaties directly, without referring to the legislature, thus revealing a gap in treaty enforcement between the two systems. In conclusion, the thesis finds that although the incorporation of treaties into Algerian law is constitutionally recognized, their judicial implementation remains limited. This calls for structural reforms, including legal revisions, enhanced training for judges, and clearer procedural mechanisms, to strengthen Algeria’s compliance with its international obligations and to support the judge’s role as a link between domestic and international law within the rule of law framework | |
