الوعد بالتعاقد في البيوع العقارية هو عقد يلتزم بمقتضاه شخص يدعى الواعد، بأن يبيع عقار الى شخص آخر يدعى موعود له اذا ما أبدى هذا الأخير رغبته في الشراء خلال مدة معينة، كما يحتاج الى انعقاده توفر جميع أركانه كما هو الحال في بقية العقود اذ وجب افراغه في قالب رسمي كما وجب شهره وفقا لما نص عليها القانون، وله عدة صور فقد يكون وعدا ملزما لجانب واحد أو وعدا متبادلا. اذا انعقد الوعد بالتعاقد في البيوع العقارية صحيحا فانه يرتب مجموعة من آثار قانونية تختلف بحسب المرحلة الناتجة عنها رغبة الموعود له في الشراء فترة ما قبل ابداء و فترة ما بعد ابداء. وينقضي عقد الوعد بالتعاقد في البيوع العقارية لعدة أسباب منها ما هو خاص بانقضاء المدة المحددة للوعـد، وينتهي بطرق عامة من خلال ابطال عقد الوعد بالبيع العقاري لسبب من الأسباب أو بهلاك العقار. الكلمات المفتاحية: البيوع العقارية، بيع عقار، الوعد بالتعاقد. Elle doit également être conclue si. tous ses éléments sont réunis, comme c'est le cas dans le reste des contrats, car il doit être exprimé sous une forme officielle et doit être publié conformément à ce qui est stipulé dans la loi. Il peut s'agir de plusieurs formes. promesse contraignante pour une partie ou promesse mutuelle. Si la promesse de contracter une vente immobilière est valable, elle crée un ensemble d'effets juridiques qui varient selon le stade résultant du désir d'achat du promettant, la période avant le début et la période après le début.
