Abstract: The topic of this study addresses the legitimacy of the international penalty, where the punishment was considered as a mechanism for maintaining international peace and security. The diversity of penalties in international law is a designed to align with the nature of acts that violate international norms. In order for these penalties to be effective, they must be dual in nature, aimed at both private citizens and legal entities like nations and organizations established by international advancements in several domains. Due to this duality, penalties have evolved to fit into the world order and match the nature of the subjects they are targeting. To ensure that penalties serve as mechanisms for maintaining collective security rather than acting arbitrarily, they must be clearly defined in legal texts that correspond to the criminalized acts. Chapter VII of the United Nations Charter serves as the legitimate basis for taking penal measures against states and individuals. Furthermore, the International Criminal Court (ICC) adheres to the principle of legality in its statute, ensuring that judges are bound by legal texts when issuing penal judgments. Despite this, the ICC's subject matter jurisdiction is limited. However, the United Nations Security Council (UNSC) has the authority to refer cases to the ICC under certain objective conditions, although the veto power of the permanent members of the UNSC remains a crucial factor. If the UNSC determines that an international crime falls within the ICC's jurisdiction, it can initiate proceedings.
