ملخص : تتناول مذكرة الماستر موضوع الخصومة أمام المحكمة الإدارية للاستئناف في الجزائر، باعتبارها مرحلة هامة من مراحل التقاضي الإداري. وتهدف الدراسة إلى توضيح طبيعة هذه الخصومة، وشروط قبول الاستئناف، والإجراءات المتبعة أمام المحكمة الإدارية للاستئناف، إضافة إلى آثار الحكم الاستئنافي. وقد تم التركيز على الإطار القانوني المنظم لها وفقاً لقانون الإجراءات المدنية والإدارية، وتحليل القرارات القضائية في هذا المجال. وتُظهر الدراسة أهمية هذه المحكمة في ضمان الرقابة القضائية الفعالة وتحقيق مبدأ المشروعية في القرارات الإدارية. كلمات مفتاحية : المحكمة الإدارية للاستئناف،الخصومة القضائية أو التقاضي،إجراءات الاستئناف أو مسار الطعن بالاستئناف Abstract : This Master's thesis addresses the issue of litigation before the Administrative Court of Appeal in Algeria, considering it a crucial stage in the administrative litigation process. The study aims to clarify the nature of such litigation, the conditions for the admissibility of appeals, the procedures followed before the Administrative Court of Appeal, and the effects of appellate rulings. It focuses on the legal framework that governs this process, according to the Code of Civil and Administrative Procedures, and analyzes judicial decisions in this field. The research highlights the importance of this court in ensuring effective judicial oversight and upholding the principle of legality in administrative decisions. RESUME : Ce mémoire de master traite de la problématique du contentieux devant la Cour administrative d’appel en Algérie, considérée comme une étape cruciale du processus de contentieux administratif. L’étude vise à clarifier la nature de ce contentieux, les conditions de recevabilité des recours, les procédures suivies devant la Cour administrative d’appel, ainsi que les effets des décisions rendues en appel. Elle s’intéresse au cadre juridique qui régit cette procédure, conformément au Code de procédure civile et administrative, et analyse les décisions jurisprudentielles en la matière. La recherche met en lumière l’importance de cette juridiction dans l’exercice d’un contrôle juridictionnel effectif et dans le respect du principe de légalité des actes administratifs.
