Summary Illegal migration is a global phenomenon affecting all countries of the world. However, it has acquired a distinct character in the Mediterranean basin, where it has become a vexing issue for countries and governments in the region, especially after the humanitarian disasters it has caused. The international community has unanimously criminalized illegal migration and condemned migrant smuggling. Addressing this phenomenon does not stop at criminalization and punishment alone, but rather extends to developing mechanisms for its prevention and thwarting. Algeria has followed suit, given its geographical location as a Mediterranean and African country, distinguished by its vast expanse and extensive borders connected to several African countries. This has made it a link for African migrants dreaming of reaching the European continent. It has witnessed numerous and varied cases of illegal migration, both by its own citizens and foreigners arriving there with the intention of settling or transiting. Therefore, it was imperative to seek ways and methods to combat and prevent it. Through our study of the punitive policy to combat illegal migration, its nature and the efforts to combat it at the national and international levels, we have discovered that it—the crime of illegal migration—is an internal crime that countries cooperate to combat. It is a transnational crime whose effects extend beyond the borders of a single state. It is usually committed by organized crime networks active in the field of migrant smuggling across source, transit, and destination countries. This justifies the efforts of the international community and international organizations to utilize all means and mechanisms to combat it. Keywords: illegal migration, international community, migrants.
