تطبيق مبادئ الحوكمة في الصفقات العمومية

Abstract

الملخص: تعد الصفقات العمومية الوسيلة الأمثل والاداة الأساسية التي وضعها المشرع في أيدي الهيئات العمومية والقطاع العام لتنفيذ مختلف المشاريع المتعلقة بتجهيز وتسيير المرافق العامة، وكونها ذات ارتباط وثيق بالأموال العمومية فإنها غالبا ما تكون عرضة للفساد بشتى صوره، لذلك حرص المشرع على تجسيد مبادئ الحوكمة في هذا المجال الحساس عبر جميع مراحل الصفقة بداية من مرحلة الإبرام إلى غاية مرحلة التنفيذ، وهذا من خلال تأكيده على ضرورة الالتزام بالمبادئ الأساسية للصفقات العمومية والاعتماد على مختلف الآليات على غرار الرقابة بمختلف أنواعها لضمان حوكمة مجال الصفقات العمومية والحفاظ على المال العام وحمايته من الفساد. الكلمات المفتاحية: الصفقات العمومية، الحوكمة. Summary: Public procurement is considered the optimal means and fundamental tool placed by the legislator in the hands of public bodies and the public sector for the implementation of various projects related to equipment and the management of public facilities given its close connection with public funds, it is often subject to abuse and corruption, for this reason the legislator was keen to embed the principles of governance in this sensitive field, throughout all stages of the contract from the awarding stage to the final implementation phase, this is done by emphasizing the need to commit to the fundamental principles of public procurement governance and by relying on various monitoring mechanisms, such as oversight bodies to ensure transparency in all its forms, protect public funds, and prevent corruption. Résumé: Les marchés publics constituent le moyen idéal et l’outil fondamental mis en place par le législateur entre les mains des organismes publics et du secteur public pour la réalisation des différents projets liés à l’équipement et à la gestion des services publics, étant étroitement liés aux deniers publics, ils sont souvent exposés à diverses de corruption c’est pourquoi le législateur a tenu à concrétiser les principes de la gouvernance dans ce domaine sensible à travers toutes les étapes du marché, depuis la phase de passation jusqu’à celle de l’exécution, cela se fait par l’insistance sur le respect des principes fondamentaux des marchés publics et le recours à divers mécanismes, tels que les différents types de contrôle, afin de garantir la gouvernance des marchés publics et de préserver les fonds publics contre la corruption.
