حرية التعبير في الجزائر على ضوء قوانين الإعلام

Abstract

ملخص الدراسة : تعتبر حرية التعبير قيمة إنسانية لا تقبل المساومة كما أنها في بعدها الإعلامي تعكس رغبة الإنسان والجماهير عموما في إبراز حقها في التعبير عن تطلعاتها همومها وانشغالاتها ،وكل هذا منصوص عليه في المواثيق والقوانين الدولية وكذا دساتير الدول من أجل ضمان حق الناس في التعبير عن آرائهم بكل حرية وضمن ضوابط محددة .حرية التعبير في الجزائر ليست استثناء عن بقية العالم بل مندمجة ضمن هذت السياق ولو بدرجات متفاوتة، لكنها واقع قائم بذاته وتطرح نقاش عن حجم هذه الحرية ومدى تجسدها وحجم الضمانات المتاحة لها والقيود المفروضة عليها ،وشكل التعددية الإعلامية ومدى انسجام الممارسة الإعلامية مع محتوى الضمانات المنصوص عليها في الدساتير وقوانين الإعلام المتعلقة بحرية التعبير والإعلام في الجزائر . Abstract: Freedom of speech, alsoreferred to as freedom of expression, is an inherent and indispensable human value. Within the realm of media, it signifies the collective desire of individuals and the general public to exercisetheir right to openlyconveytheir ambitions, concerns, and viewpoints. This fundamental right finds protection in international agreements, laws, and constitutions of nations, delineating the boundarieswithinwhichindividuals can articulatetheirideas. In Algeria, freedom of expression is not an anomaly but rather an integrated aspect within the societalfabric, albeitwithvaryingdegrees of implementation. Nevertheless, itstimulatesdeliberationsconcerning the scope and actualization of this liberty, the safeguardsavailable, the constraintsimposed, and the attainment of media pluralism. Furthermore, it prompts examination of the harmonization of professional practices with the constitutional and legal provisions governingfreedom of expression and the media.
