| dc.description | تعتبر جريمة شهادة الزور واليمين الكاذبة من الجرائم العمدية التي تحتاج لقيامها توافر الركن المعنوي إضافة للركن الشرعي والركن المادي، وهي عائق من عوائق تحقيق العدالة وإلحاق الضرر بالغير من خلال تغيير الوقائع بالكذب، إذ تقوم أساسا على أداة اليمين أمام الجهات القضائية المختلفة، حيث اعتبر المشرع الجزائري جريمة شهادة الزور واليمين الكاذبة جنحة يعاقب عليها القانون وذلك من خلال العقوبة المقررة لها في المواد 232 و 240 من قانون العقوبات وما يليها، كما يحق لكل من تضرر من هذه الجريمة طلب التعويض نظير الضرر اللاحق. الكلمات المفتاحية: جريمة شهادة الزور، اليمين الكاذبة، التشريع الجزائري. summary: The crime of perjury and false oathsisconsidered an intentional crime thatrequires the presence of the moral element in addition to the legalelement and the materialelement. Il constitue un obstacle à l'obtention de la justice et au préjudice causé à autrui en modifiant les faits en mentant. car il repose principalement sur l'instrument du serment devant les différentes autorités judiciaires, comme le législateur l'a considéré comme algérien : Le délit de parjure et de faux serment est un délit puni par la loi à travers la peine qui lui est prévue aux articles 232 et 240 du Code de procédure pénale.
