دور المحكمة الدستورية في حماية وترقية الحقوق والحريات

Abstract

محكمة الدستورية عبارة عن مؤسسة رقابية مستقلة، لها تشكيلتها وهياكلها الخاصة التي تساعدها على آداء مهامها على أتم وجه، تمارس المحكمة الدستورية اختصاصاتها الرقابية التي نص عليها التعديل الدستوري لسنة 2020 في مجال رقابة الطابقة ورقابة الدستورية، لكن ليس من تلقاء نفسها تتحرك وانما بواسطة آلية الإخطار بواسطة جهات محددة في التعديل الدستوري2020. كما تمارس آلية الدفع بعدم الدستورية المستحدثة بموجب التعديل الدستوري لسنة 2016 بإحالة من المحكمة العليا أو مجلس الدولة عندما يدعي أحد الأطراف في المحاكمة امام جهة قضائية أن الحكم التشريعي أو التنظيمي ينتهك وحقوقه أو حرياته التي يضمنها الدستور. تُمارس هذه الألية وفق ضوابط شكلية و أخرى موضوعية . إضافة لهذه الاختصاصات تمارس اختصاصات عامة ممثلة في رقابتها على العمليات الانتخابية فض النزاعات بين السلطات الدستورية والاختصاص التفسيري والاستشاري. وتعتبر قراراتها نهائية وملزمة لكل السلطات. الكلمات المفتاحية: المحكمة الدستورية مستقلة، الدفع بعدم الدستورية

In addition to these competencies, it exercises general competencies represented in its oversight of electoral processes, settling disputes between the constitutional authorities, and interpretative and advisory jurisdiction.
